HomeMy WebLinkAbout0578'W ORDINANCE NO. 57S (1973 Series) AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO AMENDING A1P,TICLE VII, CI- LPTLR 4, PART I OF THE MUNICIPAL CODE BY ADDING SECTION 7410.7.5 REQUIRING DEVELOPERS TO INSTALL CERTAIN WATER SYSTEM IMPROVENMI -ITS FOr, FIRE PROTECTION, AND AUTHORIZING PARTIAL r�EI1Vj3Ur.SE1VMNT THEREFOR.. BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. The Municipal Code is hereby amended by adding thereto Section 7410.7.5 and subsections thereof as follows: "7410.7.5 - TIATER SYSTEM ItiIP %OVEIvIENTS FOR FIRE Pr�.OTECTION. 7410.7.5.1 - DEiiINITIONS: For the purposes of this section the following definitions shall apply: (a) ADEQUATE WATER DISMIBUTION SYSTEM: A system of public water mains capable of supplying a sufficient quantity of water to satisfy simultaneously the maximum daily rate of con- sumption and the required fire flow for a given site . (b) RELIABLE =:TATER DISTRIBUTION SYSTEM: An adequate water distribution syste:a which is capable of continuing to supply water to each fire hydrant at a specific site during a shut -down of any individual section of the public system, exclusive of the adequate transmission system to which the distribution system is connected. (c) REQUIRED FIRE FLOW: The rate of flow required by the Fire Chief pursuant to the authority of Section 13.301 (c) of the Uniform Fire Code as amended by Municipal Code Section 3120.4.9 and determined in conformance with the Guide for Deterraination of Required Fire Flow as published by the Insurance Services Offices, dated July, 1972, or any subsequent recognized standard adopted by resolution of the City Council. (d) iyME,,IUT; DAILY RATE OF COIF ?SU1,!TTION: The average rate of flow, as estimated by the ylater Department Director from actual City records, which is consumed during a twenty- four ?lour period at maximum use. (e) ADEQUATE MANSMISSION SYSTEM: A water main system currently designated by the Council as capable of supplying simultaneously, at a specific site under consideration, the required fire flow and the maximum daily rate of consumption. The Master 'Water Plan shall show all such adequate transmission systems. Ordinance No. 578 (1973 Series) Page 2 7410.7.5.2 - VILTER SERVICE FM FIRE PROTECTION: (a) FIRE HYDRANTS: For all projects for which the installation of one or more San Luis Obispo City Standard Fire Hydrants are required by the Fire Chief pursuant to the authority of Uniform Fire Code Section 13.301 (c), such hydrant or hydrants shall be incorporated into a reliable water distribution system which is directly connected to an adequate transmission system. Each City Standard Fire Hydrant required shall be operative and accepted by the Water Department Director prior to the commencement of cor_zbustible construction on the project. Upon acceptance by the City of any City Standard Fire Hydrant constructed by the City or by City administered contract awarded in compliance with applicable bidding requirements, the Vlater Department Director shall determine the total extent of the properties benefitted by the hydrant installation and shall assign to each parcel or portion of parcel benefitted, a share of the total cost of the hydrant installation. Such assigned shares shall be approved by the City Council. The extent of the properties benefitted shall be determined in accordance with the recommendations of the Fire Protection Handbook, 13th Edition, 1969, published by the National Fire Protection Association, or any subsequent recognized standard adopted by resolution of the City Council. As a condition to the issuance of a building permit for construction upon a parcel or portion of a parcel to which has been assigned a share of the cost of a City Standard Fire Hydrant, the permittee shall reimburse to the City, or to the party originally funding the hydrant construction, the total assigned share. Such reimbursement obligation shall exist for a period of fifteen (15) years after City acceptance of said fire hydrant. (b) VIATEI 1, /iLIN I1MIPROVEIVIENTS FOR FIRE PROTECTION: Upon acceptance by the City of water mains installed to provide a reliable water system in accordance with subsection (a) hereof, and if such mains have been constructed by the City or by City administered contract awarded in compliance with applicable bidding requirements, the slater Department Director shall determine the total extent of the properties benefitted by the water main installation and shall assign to each parcel or portion of parcel benefitted, a share of the total cost of the installation. Such assigned shares shall be approved by the City Council. Ordinance No. 578 (1973 Series) Page 3 The extent of the properties benefitted shall be determined in accor::ance with the recommendations of the Fire Protection Handbook, 13th Edition, 1969, published by the National Fire Protection Association, or any subsequent recognized standard adopted by resolution of the City Council. Such reimbursement obligation shall exist for a period of fifteen (15) years after City acceptance of said water main. 7410.7.5.3 - REIDMURSEMENT FOr: DEPRECIATED FACILIT MS: Whenever new water mains or City Standard Fire Hydrants are privately funded in order to comply with Section 7410.7.5.2, titled Water Service for Fire Protection, and such new facilities duplicate or replace existing operative, but inadequate water mains or fire hydrants, the party funding such new facilities may be reimbursed by the City for the depreciated value of the existing facilities. The amount of such reimbursement shall be determined by the City Council, but shall not exceed 80% of the value of a newly installed equivalent of the duplicated or replaced facilities as determined by the 'Mater Department Director." SECTION 2.
