WHEREAS, this Council on November 6, 1972, adopted
Urgency Ordinance To. 568 to prohibit all construction in the
Los Osos Valley and Lower Higuera areas of the City for the
reasons set forth in Section 1 of said ordinance, with
certain listed exemptions from said prohibitions as set forth
in Section 4 thereof; and
`THEREAS, within recent weeks the City has experienced
several periods of dangerously low water pressure and supply
in said areas, thereby indicating the imminent threat of
serious health and fire dangers through contamination of the
water supply and inadequate water for fire suppression; and
WHEREAS, a practical and satisfactory correction of
said health and fire dangers does not appear to be reasonably
attainable before November, 1974, the expiration date of said
Ordinance No. 563; and
WHEREAS, this Council deems the water supply situation
in said areas now to be even a more critical threat to the
public health, safety and welfare than was recognized at
the time of the adoption of Ordinance No. 565; and
WHEREAS, upon full consideration after a duly noticed
public hearing held this date this Council finds and determines
that Section 4 of Urgency Ordinance Ho. 563 should be amended
to remove single family residences and mobilehomes from the
exemptions to the construction prohibitions in' said Ordinance.
11017, THEREFORE, BE IT ORDAI;.IED by the Council of the
City of San Luis Obispo as follows:
SLCTIOO 1. Amendment to Ordinance Mo. 568. Section 4
of Ordinance No. 568 (1972 Series) is hereby amended to read
as follows:
Ordinance Ito. 586 exemptions.
Expired November 1 1974 by 5 of Section 3 shall not apply to the
operation of law.

1. Construction authorized by a valid and unexpired
building permit which was issued by the City on or
before October 24, 1972.
2. Construction which is served by an acceptable
alternate water supply system which satisfies the
criteria established by the Water Department in the
report entitled: REPORT 010 THE I1,1STALLATIO a OF
TEMPORARY WATER SUPPLIES TO NEW DEVELOPiM7idTS I -iJ
THE LOWER I�IGUERA AREA AND THE LOS OSOS VALLEY,
dated November, 1972, a copy of which is on file
in the office of the Water Director. Any such
alternate water system shall be installed, operative
and approved by the City prior to commencement of
combustible construction.
3. Construction of alterations or additions to
existing single family residences.
4. (Deleted) .
5. (Deleted).
6. Construction of swimming pools.
7. Construction of temporary offices and storage
facilities reasonably necessary in connection with
authorized construction or development activity.
S. Construction of public works other than buildings."
SECTION 2. Effectivity.
A. Single Family Residences. Construction shall
be permitted for single family residences authorized by a
valid and unexpired building permit issued on or before
June 18, 1973.
B. Mobilehomes. Construction of mobilehomes within
mobilehome parks shall be permitted for mobilehomes (a) for
which the owners had entered into a bona fide and enforceable
contract of purchase on or before June 13, 1973, or (b) for
which the mobilehome park: had accepted a bona fide space
reservation for a mobilehome on or before said date.
The Director of Planning shall determine at the
earliest possible date the actual number of additional

mobilehomes authorized by this Section 2 in each mobilehome
park, and shall request the Planning Commission to partially
revoke the use permit in each mobilehome park to reflect the
actual number of mobilehomes which will be permitted in each
park under the prohibitions of this ordinance and Ordinance
No. 568.
SECTION 3. Provisions of Ordinance No. 563 Applicable.
This Ordinance is a supplementary and partially
superseding ordinance to Ordinance No. 568. All provisions
of Ordinance No. 563 not in conflict herewith shall remain in
full force and effect and may be used in construing and
interpreting this Ordinance including without limitation, the
provisions of Ordinance No. 568 concerning Definitions, Real
Property Affected, Violations, and Termination Date.
SECTION 4. Immediate Effect.
This is an emergency ordinance necessary for the pro-
tection and preservation of the public health, safety and
welfare, and it shall take effect immediately upon its
adoption, provided that it is approved by at least four
affirmative votes. The reasons for urgency are the dangers
to public health and to life and property which presently
exist as a result of the City's inadequate water system in
the affected areas, and the necessity that the City take
immediate action to prohibit future construction which would
increase the said danger through increased water usage and
greater fire -flow requirements.
The City Clerk shall cause this ordinance to be
published once within five days in a newspaper of general
circulation, but delay in publication, or even failure to
publish, shall not affect the validity of the ordinance.
