ORDINANCE NO. 597 (1973 Series)
AN URGENCY ORDINANCE'OF THE CITY OF SAN LUIS
OBISPO RELATING TO THE AUTOMATIC SENDING OF
TELEPHONE MESSAGES TO THE POLICE DEPARTMENT
OR FIRE DEPARTMENT.
BE IT ORDAINED by the Council of the City of San Luis Obispo
as follows:
SECTION 1. Section 4227 is hereby added to the Municipal
Code as follows:
"Section 4227. Automatic Calling Devices Prohibited
No person except a public utility engaged in the business
of providing communications, services and facilities shall
use or operate, attempt to use or operate or cause to be
used or operated, or arrange, adjust, program or otherwise
provide or install any device or combination of devices that
will, upon activation, either mechanically, electronically
or by other automatic means, initiate an intrastate call
and deliver a recorded message to any telephone number
used for the receipt of emergency or governmental adminis-
trative messages by the San Luis Obispo Police Department
or the San Luis Obispo Fire Department.
The term "telephone number" includes any additional
numbers associated with such emergency or governmental
administrative telephone number through the use of a rotary
or other system whereby additional telephone calls to the
number are connected to other numbers when the first number
is in use."
SECTION 2. This ordinance is adopted as an emergency measure
for preserving the public health, safety and welfare, and it shall
take effect at once upon its passage by at least four affirmative
votes. The reasons for urgency are that several such devices have
been installed within the City without prior knowledge or approval
by the Police Department or Fire Department and there is the danger
that such devices could tie up the Police and Fire Department

switchboards and prevent response by the Police and Fire Depart-
ments to emergencies which endanger the public safety and welfare
throughout the City.
SECTION 3. The City Clerk shall cause this ordinance to be
published once within five days in a newspaper of general circulation,
but delay in publication, or even failure to publish, shall not
affect the validity of the ordinance.
INTRODUCED AND FINALLY PASSED by the Council of the City of
San Luis Obispo at a Regular Meeting thereof held on the 1st day
of October, 1973, on motion of Councilman Brown, seconded by
Councilman Gurnee, and on the following roll call vote:
AYES: Councilmen Brown, Graham, Gurnee, Norris
and Mayor Schwartz
