ORDINANCE 110. 603 (1974 Series)
AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO
AMENDING THE MUNICIPAL CODE TO REQUIRE REVIEW
BY THE CITY OF ALL PROPOSED CONSTRUCTION AND
GRADING ACTIVITIES WITHIN CERTAIN FLOODED AND
FLOOD PRONE AREAS AND WITHIN TWENTY FEET (20')
OF THE TOP OF THE BANKS OF CERTAIN WATERWAYS
PRIOR TO THE ISSUANCE OF BUILDING AND GRADING
PERMITS THEREFOR; AND PROVIDING A PROCEDURE
FOR SAID REVIEW.
BE IT ORDAINED by the Council of the City of San Luis
Obispo as follows:
SECTION 1. The Municipal Code is hereby amended by
adding thereto Section 5122 and subsections as follows:

SECTION 8122. REVIEW OF PLANS PRIOR TO ISSUANCE OF BUILDING
AND GRADING PERMITS IN FLOOD AREAS AND ADJACENT
TO WATERWAYS. .
1. Permits not to be issued without plan approval.
a. No building or grading permit shall be issued for any
activity upon land designated as "Flooded" or ".Flood
Prone" upon Exhibit "A" map attached hereto or upon
land situated within twenty feet (20') of the top of
the banks of designated waterways as shown upon
Exhibit "B" map attached hereto, prior to review and
approval by the Waterways Board of the plans for the
proposed building or grading work.
b. For the purposes of this ordinance, the "top of the
bank" shall mean that point on either bank which
represents the water level at full capacity of the
waterway without flooding or overflowing on either
side of said waterway. The twenty foot (20') distance
shall be measured horizontally from the aforesaid point
and perpendicularly to the said waterway.
C. The prohibitions herein shall not apply to:,.
(1) Public Works.
(2) Rehabilitation or repair work which is reasonably
necessary to restore buildings or premises which
have been damaged by flood, fire, earthquake.or
other natural disaster.
(3) Emergency work necessary for the protection of the
public health, safety and welfare.
(4) Private projects specifically approved by the City
Council for the construction of retaining walls,
culverts, bridges, drainage improvements and
similar public works type facilities.
(5) Projects exempted in the City's Policies and
Standards for Flood Plain Management.
2. Policies and Standards for Flood Plain Management.
The review by the Waterways Board shall be_in accordance
with the Policies and Standards for Flood Plain Management,
dated January 7, 1974 , adopted concurrently here-
with, and such amendments thereto as may be adopted by
Resolution of the Council from time to time. Current copies
of said Policies and Standards shall be maintained on file
in the Offices of the City Clerk, City Engineer and Planning
and Building Department as public records."

SECTION 2. Resolutions No. 2486 (1973 Series) and No.
2496 (1973 Series) are hereby repealed.
SECTION 3. This Ordinance, together with the ayes and
noes, shall be published once in full, at least three days prior
to its final passage, in the Telegram - Tribune, a newspaper
published and circulated in said City, and the same shall go
into effect at the expiration of thirty days after its said
final passage.

RESOLUTION 110. 2685 (1974 Series)
A RESOLUTION OF THE COUNCIL OF THE CITY OF
SAN LUIS OBISPO ADOPTING CRITERIA, STANDARDS
AND POLICIES FOR DEPARTMENTAL USE IN MAKING
THE FACILITIES DETERMINATIONS REQUIRED BY
ORDINANCE NO. 604 -A.
BE IT RESOLVED by the Council of the City of San Luis
Obispo as follows:
This Council hereby approves and adopts.the criteria,
standards and policies for departmental use in making the
facilities determinations required by Ordinance No. 604 -A.
A copy of said criteria, standards and policies dated
November 18, 1974, is attached heretq marked Exhibit "J." and
thereby incorporated herein.
On motion of Councilman Norris, seconded by Councilman
Gurnee, and on the following roll call vote:
AYES: Councilmen Brown, Graham, Gurnee, Norris
and Mayor Schwartz
