HomeMy WebLinkAbout0630ORDINANCE NO. 630 (1975 Series) AN URGENCY ORDINANCE OF THE CITY OF SAN LUIS OBISPO LEASING CITY JAIL FACILITIES TO THE COUNTY OF SAN LUIS OBISPO FOR JUVENILE DETENTION PURPOSES. WHEREAS, this Council by Resolution No. 2693 approved, and authorized the Mayor to sign, all necessary documents for the finalization of a lease agreement with the County of San Luis Obispo for use of the jail facility portion of the City Police Building for juvenile detention purposes; and WHEREAS, a final form of the lease agreement has now been completed and Charter Section 725 requires the leasing of City real property to be approved.by ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF SAN LUIS.OBISPO AS FOLLOWS: SECTION 1. The Lease Agreement between the County of San Luis Obispo and the City of San Luis Obispo, dated December 16, 1974, a copy of which is on file in the office of the City Clerk, is hereby approved, and the Mayor is authorized to execute-said Agreement on behalf of the City. SECTION 2. The County use of said real property since December 11, 1974, under the authority of Resolution No. 2693 is hereby approved and ratified in all respects. SECTION 3. This ordinance is adopted as an urgency ordinance for preserving the public.health, safety and welfare, and it shall take effect upon.its passage by at least four affirmative votes. The reasons for urgency are that the County of San Luis Obispo has closed its. local juvenile detention facilities and is urgently in need of suitable temporary Ordinance No. 63-,; -2- - (1975 Series) detention facilities locally; the leased property provides suitable temporary detention facilities; and the County's juvenile program provides services for juvenile residents of the City of San Luis Obispo. The City Clerk shall cause this ordinance to be.published once within five days after the adoption hereof in a news- paper of general circulation within the City, but delay .in publication, or even failure to publish, shall not affect the validity of the ordinance. INTRODUCED AND FINALLY PASSED by the Council of the City of San Luis Obispo at a Regular Meeting thereof held on the 6th day of January, 1975, on motion of Councilman Gurnee, seconded by Councilman Brown, and on the following roll call vote: AYES: Councilmen Brown, Gurnee, Norris and Mayor Schwartz NOES: Councilman Graham ABSENT: None ATTEST:
