AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO
AMENDING THE MUNICIPAL CODE TO COMPLY WITH
CALIFORNIA VEHICLE CODE.SECTIONS CONCERNING
LICENSING OF BICYCLES.
BE IT ORDAINED by the Council of the City of San Luis Obispo
as follows:
SECTION 1. Municipal Code Sections 3220, 3220.1, 3220.2,
3220.3, 3220.4, 3220.5, 3220.6, 3220.7 and 3220.8 are hereby
repealed.
SECTION 2. New Municipal Code Sections 3220, 3220.1
through 3220.8 are hereby added to the Municipal Code as follows:
Section 3220. BICYCLE. License to Operate.
No person shall operate or use a bicycle propelled
wholly or in part by muscular power upon any of the
streets, alleys or public highways in the City, without
first obtaining a City license therefor.

The license when issued shall entitle the licensee thereof,
or any other person with the permission of.the licensee to
operate such bicycle for which the license has been issued,
upon all the streets, alleys, and public highways, exclusive
of the sidewalks thereof, in the City.
Section 3220.2. Same. License Plates.
The license shall be* attached to the bicycle for which
it is issued, and shall remain attached during the period
for which the license is valid. The City shall keep a
record of the date of issue of each license, to whom issued,
and the number thereof.

Section 3220.3. Same. Second -hand Bicycles. Record of Sale.
All persons engaged in the business of buying or trading in
second -hand bicycles,..and.all persons engaged in the business
of selling new or second -hand bicycles are hereby required to
make a report to the Police Department, which report shall
specify:
a. The name and address of the person from whom each
second -hand bicycle is purchased, or traded -in; or
b. The name and address of the person to whom a new
--or second -hand bicycle is sold.
C. The description of each bicycle purchased, traded-
in or sold.
d. The frame number thereof or other identification
number.
e. The number of any license attached thereto, if any.
All reports required by this section shall be in writing
and shall be filed with the Police Department within twenty -
four hours after each purchase or trade -in of a second -hand
bicycle and within twenty -four hours after each sale of a
new or second -hand bicycle.
Section 3220.4. Same. Sale of Bicycle.
It shall be the duty of every person who sells or transfers
ownership of any bicycle, to report such sale or transfer by
returning to the City the registration card issued to such
person as licensee thereof, together with the name and
address of the person.to whom the bicycle was sold or trans-
ferred. Such report shall be made within ten days after the
date of sale or transfer. It shall be the duty of the pur-

chaser or transferee of such bicycle to apply for a transfer
of registration thereof within ten days after the date of
sale or transfer.
Section 3220.5. Same. Destroying Number.
No person shall wilfully or maliciously remove, destroy,
mutilate or alter the number of any bicycle frame licensed
pursuant to this ordinance.
Section 3220.6. Same. Destroying License, Plate, Seal, Etc.
No person shall remove, destroy, mutilate or alter any City
license, seal or registration card during the time in which
such license plate, seal or registration card is operative
and valid.
Section 3220.7. Same. License Fee.
The license fee.to be paid for each bicycle shall be
established by Resolution of the Council from time to time
and shall.be paid in advance; and pursuant to Section 3220.4
such license may be transferred when the ownership of the
bicycle is transferred, and a fee established by Resolution
of the Council from time to time shall be paid for the
registration of such transfer. All license fees collected
shall be used in accordance with the provisions of California
Vehicle Code Section 39004.
Se'ct'ion 3220.8. Same. Permanent License.
All licenses issued on or after the effective date of
this ordinance shall be issued pursuant to the fees authorized
by Section 3220.7 provided that any lost or mutilated license
plate must be reported to the City•within ten days and a new
license shall be issued upon payment of an amount to be
established by Resolution of the Council from time to time.

SECTION 3. This Ordinance shall take effect January l; 1976.
SECTION 4. This Ordinance, together with the ayes and noes,
shall be published once in full, at least three days before
its final passage, in the Telegram- Tribune, a newspaper
published and circulated in said City, and the same shall go
into effect January 1, 1976,.which is more than thirty days
after its said final passage.

of San Luis Obispo at an adjourned meeting thereof held on the
27th day of October, 1975, on motion of Councilman Graham,
seconded by Councilman Norris, and on the following roll call
vote:
