HomeMy WebLinkAbout0691ORDINANCE NO. 691 (1976 Series) AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO DECLARING THE NECESSITY FOR USE ON LAND DEDICATED FOR PARK PURPOSES TO BE USED FOR OTHER MUNICIPAL PURPOSES. WHEREAS, Section 37111.1 of the Government Code of the State of California requires that when a legislative body deems it necessary that land purchased in fee for any municipal purpose and subsequently dedicated by use for park purposes should be used for other municipal purposes, it may adopt an ordinance declaring the necessity and providing that such lands can be used for other municipal purposes; and WHEREAS, an equal or greater amount of City property has been dedicated and has been developed, or will within a reasonable period of time be developed for similar park purposes; and WHEREAS, the proposed use of the park land conforms to the City's General Plan; NOW, THEREFORE, BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. That certain portion of land described as follows: That portion of Lot 1 in Block 32 of the City of San Luis Obispo, according to map recorded May 1, 1878 in Book A at page 168 of Maps, described as follows: D'21'R ILIT T Beginning at the point of intersection of the southerly line of Palm Street with the easterly line of Santa Rosa Street in said City, thence easterly along the southerly line of Palm Street a distance of 10.00 feet to a point; thence southerly and parallel to Santa Rosa Street, a distance of 150.00 feet to a point; thence at right angles westerly a distance of 10.00 feet ktm 11/30/76 Page 1 of 3 0 691 Ordinance No. 691 L:. (1976 Series) to the easterly line of Santa Rosa Street; thence northerly along said easterly line to the POINT OF BEGINNING. DTDIIDT TT Beginning at the point of intersection of the southerly line of Palm Street with the easterly line of Santa Rosa Street in said City; thence easterly along the southerly line of Palm Street a distance of 30.00 feet to the true POINT OF BEGINNING; thence continuing easterly along said southerly line a distance of 8.00 feet to a point; thence at right angles southerly a distance of 5.00 feet to a point; thence westerly parallel to Palm Street a distance of 8.00 feet; thence at right angles northerly to the true POINT OF BEGINNING. Which said land is a portion of a larger parcel of land presently dedicated to park purposes and is necessary for use for other municipal purposes, to wit: The widening of Santa Rosa Street, and said land shall be used for such other municipal purpose. SECTION 2. This ordinance, together with the ayes and noes, shall be published once in full, at least three (3) days prior to its final passage, in the Telegram- Tribune, a newspaper published and circulated in.said City, and the same shall go into effect at the expiration of thirty (30) days after its said final passage.
