HomeMy WebLinkAbout0092NORDINANCE NO. (NEW SERIES) AN ORDINKNCE REGULATING THE PARKING OF VEHICLES ON THE STREETS OF THE CITY OF SAT LUIS OBIS1'O. Be it ordained by the Council of the City of San Luis. Obispo as follows: Sec. 1. GENERAL PROVISIONS. No operator of any vehicle shall stop, leave standing, permit :to be stopped or permit to be left standing, such vehicle: (a) within 25 feet of any corner; (b) within 15 feet of any fire hydrant; (c) directly in front of any building in which is housed fire fighting apparatus belonging to the City; (d) bn any reserved space, except to take on or let off passengers. Sec. 2. BUSINESS DISTRICT. No operator of any vehicle shall leave standing or permit to be left standing such vehicle on MONTEREY STREET between Osos and Chorro Streets, on MORRO STREET between Monterey and marsh Streets, on CHORRO STREET between Mon- twrey and Higuera Streets, on HIGUERA STREET between Morro and Nip - omo Streets, except when such vehicle is parallel with the curb line and entirely within lines designating parking spaces, provided that an operator of a vehicle may stop such vehicle on such streets parallel to the curb and as near the curb as possible for such time, and only such time, as is required to load or discharge passengers. Sec. 3. PARKING SPACES. Parking spaces on the portions of the streets mentioned in Section 2 hereof shall be marked by lines approximately eight feet from the curb and parallel to it, with parking spaces at least fourteen feet long and at least three feet apart. Parking spaces on all other streets and portions of streets shall be marked as designated by the Commissioner of Public Health and Safety and when so marked all parking shall conform to said mark- ings. 7� See. 4. TIME LIMIT. Except on Sundays or h1lidays no operator of a vehicle shall leave or permit to be -left standing such vehicle on the portions of the streets mentioned in Sec. 2 hereof whether on parking spaces or elsewhere for a period of more than sixty consecutive minutes between the hours of 9:00 o!clock A. M. an.d 6 :00 o'clock P. M. See. 5. LOADING AND UNLOADING. Vehicles loading or unloading merchandise may back to the curb for such period of time as is actually required to load or unload such materials, provided that in no case shall such vehicle remain backed to the curb for a longer period than twenty minutes unless the operator of such vehicle has in his possession written permit authorizing him to so do. Such permit shall be signed by the Chief of Police or Commissioner of Public Health and Safety and shall only be valid during the day issue. See. 6.. INTERSECTIONS. No operator of any vehicle shall stop the same for any purpose whatever so that any part thereof extends on to the intersection of any street or within twenty five feet of any corner. Within the meaning of this section the word "street" shall include the side walks. Sec. 7. DEFINITIONS. (a) The word "corner" as used in Subdivision (a) of Section 1 hereof and in Section 6 hereof shall mean the intersection of the curb lines extended, i. e., the curb corner as it would be if the curb were not rounded off but square; (b) The words "reserved space" as used in Sub- division (d) of Section 1 hereof shall mean a space on the street adjacent to the curb line not over twenty feet in length, directly in front of a hotel, theatre or taxicab stand designated by markers as reserved: (c) The City shall not be obliged to pay for the in- stalling of any signs hereunder but shall have entire supervision over installing the same, and it shall be unlawful to install any sign hereunder except by order of the Chief of Police. Sec. 8. CONTROL OF PO"LICE*OFFICER. Every person in charge of any vehicle standing upon any street whether on a parking space or not, shall move such vehicle at the request of any police officer; and every driver of any vehicle upon any such street or streets, shall stop when signalled so to do by any such officer. Sec. 9. CONTROL OF CHIEF OF POLICE. Subject to this ordinance the direction of traffic and parking shall be at all times be under the control tf the Chief of Police. Sec. 10. PENALTY. Any person violating any of the pro- visions of this ordinance shall be g -.ilty of a misdemeanor and shall be fined not to exceed $25.00 or imprisoned not to exceed 5 days. Sec. 11. Any and all powers which this ordinance dele- gates to either the Commissioner of Public Health and Safety or the Chief, of Police shall remain subject. to the review and revision by the Council on its own initiative. See, 12. LEGALITY. If any section, sub- section, sen- tence, clause or phrase of this ordinance is for any reason held to be illegal, such decision shall not affect the validity of the remaining portions of this ordinance. The Council hereby declares that it would have passed this ordinance and every part thereof irrespective of the fact that any one or more other sections, sub - sections, sentences, clauses or phrases be declared illegal.
