ORDINANCE NO. 100 (1958 `Series)
AN ORDINANCE GRANTING A GARBAGE COLLECTION FRANCHISE
TO THE SAN LUIS GARBAGE COMPANY
as follows: BE IT ORDAINED by the Council of the City of San Luis Obispo
SECTION 1. That pursuant to the requirements of the Charter arid
the San Luis Obispo Municipal Code, a public hearing was held on December
15, 1958, and all protests were heard and considered.
SECTION 2. That a franchise for the collection and disposal of
garbage, refuse, and rubbish within the City of San Luis Obispo is hereby
granted to Charles Cattaneo and Alvizio Rizzoli, doing business as the San
Luis Garbage Company, upon the following terms and conditions
(a) The franchise shall be granted for a term of twelve (12) years
commencing January 1, 1959.
(b) Said Company to procure and keep in force required workman's
compensation insurance and public liability insurance in the amount of
$100,000 to $200,000 for injury to persons and $25,000 for damage to prop-
erty, said liability insurance to cover both Company and City and to be
non - revokable without ten (10) days prior written notice to the City.
(c) The franchise shall be subject to' the Charter and `'hapter 2
of Article V of the San Luis Obispo Municipal Code.
(d) Company shall pay two and three - fourths per cent (2 3/4%) of
the gross cash receipts of the business with a minimum of $1,500 per year
payable quarterly.
(e) Company to provide one clean -up week without charge in the
springtime of the year.
(f) A deposit of cash of surety faithful performance bond in the
sum of $5,000.
(g) Company to provide a city dump within fifteen (15) miles of
the City subject to approval of the County of San Luis Obispo and rules and
regulations
of the
City
regarding hours of operation and dumping fees and
permitting
City to
dump
without fee.
(h) Company to maintain an office within City for payment of bills
and handling complaints, said .office to be open during regular business hours.
(i) Franchise to be subject to termination upon failure of the
Company to remedy any violations within twnety (20) days after written
notice by the City.

(j) City to have the option to purchase the personal and
real property of the Company, the price of which is to be determined by
agreement or subject to arbitration.
(k) Company shall execute a contract which is on file with
the City Clerk.
SECTION 3. That the Mayor shall be and is hereby authorized
to execute on behalf of the City that certain document entitled "Garbage
Contract" containing the provisions set forth above.
SECTION 4. This ordinance, together with the ayes and noes,
shall be published once in full, at least three days before its final
passage, in the Telegram- Tribune, a newspaper published and circulated in
said City, and the same shall go into effect at the expiration of thirty
days after its final passage.
