HomeMy WebLinkAbout0701ORDINANCE NO. 701 (1977 Series) AN ORDINANCE AMENDING PORTIONS OF ARTICLE III, CHAPTER 1, PART 2, OF THE SAN LUIS OBISPO MUNI- CIPAL CODE, TO ADOPT THE 1976 EDITION OF THE UNIFORM FIRE CODE, TOGETHER WITH AMENDMENTS AND ADDITIONS THERETO; AND REPEALING ALL ORDI- NANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH. BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. Article.III, Chapter 1, Part 2, Sections 3120.1 through. 3120.4.16 are hereby amended to read as follows: (Continued on following pages.) 0 701 ktm 4/15./77 I 'Ordinance No. 701 (1977 Series) SECTION 2. Article III, Chapter 1, Part 2,.Section 3120.4.34 of the Municipal Code is hereby amended to read as follows: SECTION 3120.4.34. Section 27.111 UFC is amended to read as follows: "Each chimney used in conjunction with any fireplace, barbeque, incinerator, or any heating appliance in which solid or liquid fuel is used, upon any building, structure, or premises, shall be maintained with a spark arrester constructed with heavy wire mesh or other non- combustible material with openings not to exceed one -half, inch. Chimneys which are non - conforming to this section shall be made to conform prior to July 1, 1978._" SECTION 3. Article III, Chapter .1, Part 2, Section 3120.4.42 of the Municipal Code is hereby amended to read as follows: SECTION 3120.4.42 Section 10.103 (e) UFC is amended to..read as follows: "No person shall place, store or keep, or permit to be placed, stored or kept, any materials the presence or burning of which would obstruct or render hazardous an exit. 1. At every exit and wherever otherwise required to clearly indicate the direction of egress, an exit sign with plainly legible letters at least six inches high.by 3/4 inch stroke shall be provided and maintained." SECTION 4. Article III, Chapter 1, Part 2, Sections 3120.4.45 and , 3120.4.46 of the Municipal Code are hereby repealed. SECTION 5. Code, of which code not less than three (3) copies, have been and are now filed in the Office of the City Clerk of the City of.San Luis Obispo, all certified as true copies by the City Clerk, and the same are hereby adopted and incorporated as fully as if set out at length herein, and from.the date on which this Chapter shall take effect the provisions thereof shall supersede the Fire Prevention Code heretofore.adopted by the City of San Luis Obispo and shall be controlling within the limits of the City of San Luis.Obispo. SECTION 3120.2 ESTABLISHMENT AND DUTIES OF BUREAU OF FIRE PREVENTION a. The Fire Prevention Code shall be enforced by the Bureau of Fire Prevention in the Fire Department of the City of San Luis Obispo which is hereby established and which shall be operated under the supervision of the Chief of the Fire Department, b. The Chief in charge of the Bureau of Fire Prevention shall be the Chief of the Fire Department. C. The Chief of the Fire Department may detail such members of the Fire Department as shall from time to time be necessary. The Chief of the Fire Department shall recommend to the City Administrative Officer the employment of technical inspectors, who, when such authorization is made, shall be selected through an examination to determine their fitness for the position. SECTION 3120.3 DEFINITIONS Wherever the word "Municipality" is used.in the Fire Prevention Code, it shall be held to mean the City of San Luis Obispo, SECTION 3120.4 Amendments made in the Fire Prevention Code. The provisions of the Uniform Fire Code, hereinafter referred to as UFC, 1976 Edition, are amended, supplemented, and repealed as follows: SECTION 3120.4.1 Section 1.205 UFC is amended to read as follows:, "The Fire Chief and members of the Fire Prevention Bureau shall have the powers of a police officer in performing their duties under this code, and shall have the powers of a peace officer as provided in California Penal Code, Sections.830.3 (k) and shall have the authority to issue citations as provided in Sections 1250 through 1254 of the San Luis Obispo Municipal Code." SECTION 3120.4.2 (a) Section 1.216 UFC is amended to add the following standards to those set forth in said section: (1) The following is added as a standard of the American National Standards Institute, Inc.: "61.1 Storage and Handling of Anhydrous Ammonia, 1966." (2) The following is added as a standard of the Compressed Gas Association, 500 Fifth Avenue, New York, N.Y. 10036: "G -8 -1964 Piping of Nitrous Oxide." SECTION 3120.4.3 Section 27.203 (c) UFC is changed to read as follows: "Hazardous storage. Where the storage or accumulation of combustible matter used in stores, apartment buildings, factories, or other similar places is a hazard or menace of fire, said storage of such materials shall be removed at least every second day." SECTION 3120.4.4 Section 15.709 (c) and (d) UFC are added to read as follows: "(c) It is required that all gasoline: service stations keep an accurate daily log of the gasoline that is delivered, stored, and dispensed at that location. The attendant on duty may maintain such a log, however, the responsibility shall be that of the occupant. (d) When in the interest of public safety or there is any indication of a. leak, the Fire Chief may require anyone with flammable liquid storage tanks to provide tests as may be necessary to prove their integrity." SECTION 3120.4.5 Section 13.208 (a) UFC is amended to read as follows: "Every building hereafter constructed shall be accessible to Fire Department apparatus by way of access roadways with all- weather driving surface of not less than twenty (20) feet of unobstructed width, and corners or curves shall not have less than a forty - six =foot (46') outside radius or a .twenty- eight -foot (28') inside 1-f-m A!19/77 radius.. The access roadway shall be capable of supporting the imposed loads of fire apparatus and having a minimum of 13 feet, 6 inches of vertical clearance. Exception: When there are not more than two'Group R, Division l or M occupancies as defined in the Building Code, the requirement of this Section may be modified when, in the opinion of the Chief, firefighting or rescue operations would not be impaired." SECTION 3120.4.5.1 Section 13.103 UFC: AUTHORITY TO REMOVE VEHICLES. The Chief and his authorized representatives shall have the power and authority to remove or cause to be removed, without notice, any vehicle, vessel, or thing parked or placed in violation of Sections 13.208 and 13.209 UFC. The owner of any item so removed shall be responsible for all towing, storage, and other charges connected therewith. SECTION 3120.4.6 Section 13.206 (b) UFC is amended to read as follows: "(a) No person shall place or keep any post, fence, growth, trash or other material or thing near any fire hydrant that would prevent such hydrant from being immediately discernible or in any manner deter or hinder the Fire Department from gaining immediate access to a -fire hydrant. (b) Fire hydrants on private property shall have no parking zones iden- tified by a red painted curb, berm, or stripe at least eight inches wide and fifteen feet long. Readily legible, permanent, all - weather signs shall be conspicuously posted with a minimum lettering of 2 inches by 1/4 inch to read: "VEHICLES IN RED NO PARKI9G ZONES TOWED AWAY AT OWNER'S EXPENSE. 4220.3 M.C., 22658 V.C., Police Department Phone 544 -5151, Fire Department Phone 543 - 6046." SECTION 3120.4.7 Section 13.208 (c) is amended to read as follows: "The access roadway shall be extended to within 150 feet of all portions of the exterior wall of all buildings and to within 40 feet of all multiple story buildings. Where the access roadway cannot be provided, approved fire protection system or systems shall be provided as required and approved by the Chief." SECTION 3120.4.8 Section 13.209 UFC: BUILDING ACCESS. (a) At least one exterior wall and a portion of the. roof of all buildings other than dwellings shall be within the designed reach limitations of the aerial ladder apparatus as it is parked on the closest public street or approved emergency access driveway. ktm 4/15/77 (b) The owner, or individual in control of emergency access roadways and streets in private developments shall conspicuously post legible permanent all- weather signs with a minimum lettering of two inches by 1/4 inch stroke at locations as required by the.Fire Department to comply with the access pro- visions of UFC Section 13.208. Signs are to read: "VEHICLES IN NO PARKING ZONES MAY BE TOWED AWAY AT OWNER'S EXPENSE. 3120.4.5.1 M.C. 13.103 UFC. Police Department Phone 544 -5151, Fire Department Phone 543 - 6046." SECTION 3120.4.9 Section 13.301 (f) UFC is amended to read as follows: "All premises where trailer coaches, mobile homes, combustible structures, buildings or portions of buildings, or hazardous amounts of any combustible or hazardous materials are constructed, located, or stored, access to such premises shall be provided conforming to UFC Section 13.208, with San Luis Obispo City standard fire hydrants provided at locations, either on -site or within City sidewalk right -of -way as may be required by the Fire Chief, and connected to a water system capable of supplying the fire flow required by the Chief. " SECTION 3120.4.10 Section 13.209 is added to read as follows: "Building address numbering. All buildings shall have displayed on their front, the assigned address number, so as to be easily seen from the frontage street. Individual numbers shall be at least five inches in height and shall be of contrasting color to that of their background. Exception: One and two family residences may use numbers with individual characters four inches or more in height." SECTION 3120.4.11 Section 13.301 (g) UFC is added to read as follows: "1. General. All buildings except separate single family dwellings, constructed in locations which are beyond the four - minute response time line shown on response map attached to Fire Department Report No. 2 -74, a copy of which is on file at Fire Department headquarters shall be provided with interior wall and ceiling construction meeting requirements of the San Luis Obispo Building Code for one -hour fire - resistive construction throughout. Exceptions: (a) One -hour fire- resistive construction is not required in buildings whose ground floor area is less than 2000 square feet unless other- wise required by provisions of the San Luis Obispo Building Code. (b) One -hour fire - resistive construction is not required in buildings equipped throughout with an approved automatic fire extinguishing system unless otherwise required by provisions of the San Luis Obispo Building Code. ktm 4/15/77 (c) One -hour fire = resistive construction is not required in build- ings provided with automatic heat and smoke detection systems prescribed by Municipal Code Section 3120.4.13 unless otherwise required by provisions of, the San Luis Obispo Building Code." SECTION 3120.4.12 Section 13.301 (h) UFC is added to read as follows: " 1. General. All buildings constructed in locations which are beyond the four - minute response time line shown'on response map attached to Fire Department Report No. 2 -74, a copy of which is on file at Fire Department headquarters, shall be designed so that windows required for rescue of occu- pants can be reached with .24-foot extension ladders carried on Fire Department pumpers. " SECTION 3120.4.13 Section 13.307 (a) is amended to read as follows: "(a) Every apartment house three stories or more in height or containing more than fifteen apartments and every hotel three stories or more in height or containing twenty or more guestrooms, shall have installed therein an approved, automatically operated fire alarm system designed to warn the occu- pants of the building in the event of fire. Such fire alarm systems shall be so designed that all occupants of the building may be warned simultaneously. 1. Every single and multi - family dwelling occupancy including mobile homes, apartment houses, condominiums, lodging houses, hotels and motels shall have installed and maintained therein approved detectors of the products of combustion other than heat only, commonly known as "smoke detectors." For the purpose of this section the latest edition of NFPA 74 "Household Fire Warning Equipment" shall be the guide for installation, maintenance and testing of smoke detectors. 2. All existing dwellings non - conforming to this Section shall be made to conform prior to sale and transfer of title, or prior to final approval by the San Luis Obispo Department of Community Development of a building permit, whichever comes first. All other existing occupancies including commercial, industrial, public assembly, educational, institutional, warehousing, hotels, motels, apartment houses, dwelling units used as rental business which are non -con- forming to this Section shall be made to conform prior to July 1, 1978. 3. Every structure used for other than residential purposes shall have installed therein an approved smoke and /or fire detection system, con- sisting of one or more detectors of products of combustion with detection units located so that all portions of the protected building are provided with adequate detection capabilities and alarm equipment either connected directly to an approved alarm center-or alarm devices on the property. The system shall meet NFPA standards. 4. A permit shall be obtained prior to installation of fire alarm devices and systems required in this section, except that the permit require- ment may be waived by the Fire Chief for systems consisting of two or less non - connected detectors. ktm 4/15/77 5. Exceptions: (a) Automatic smoke and fire detection equipment and systems may be omitted with the Fire Chief's approval, in structures whose ground floor area is less than 1000 square feet, and /or which have been provided with an approved automatic fire sprinkler system. (b) Any multi- dwelling complex containing more than eight units may conform to this requirement by providing coverage to one - fourth of.the complex each year for four consecutive years with the entire complex to be completed by July 1, 1982." SECTION 3120.4.14 Section 13.308 .(d) UFC is added to read as follows: "Where required: Standard automatic fire extinguishing system shall be installed and maintained in operable condition as specified'in this chapter in the following locations: 1. In Groups A and B occupancies when the occupancy has over 12,000 square feet of floor area which can be used for exibition or display purposes; however, the respective increases for area specified in Uniform Building Code Sections 506 and 507 shall be permitted. 2. All buildings constructed in locations which are beyond the four - minute response time line shown on response map attached to Fire Department Report No. 2 -74, a copy of which is on file at Fire Department headquarters. Exceptions: (a) A standard automatic fire extinguishing system may be omitted, with the Building Official's and Chief's approval, in buildings used exclusively for storage or use of high value electronic equipment made of non- combustible materials, providing the building is equipped throughout with a heat and "invisible products of combustion other than heat" detector system of a tested and approved design, installed to the satisfaction of the Chief." SECTION 3120.4.15 Section 13.309 UFC is added to read as follows: "1. All automatic sprinkler systems shall have a supply riser with an approved indicating control valve automatically monitored and interconnected by means of a telephone lease -line or by a method approved by the Fire Chief, so as to indicate an alarm at Fire Department headquarters or an approved central receiving station, at any time that water is transmitted through the system or that supply valves are closed. 2. All automatic sprinkler-systems shall be inspected by Fire Department representatives at least once annually. Inspections shall include a function test and an inspection regarding unauthorized water usage. ktm 4/15/77 SECTION 3120.4.16 Section 13.316 UFC is added to read as follows: "All-charges for alarm service, connection, or subscription other than those contained herein and /or established by City Council resolution shall be set by the Fire Chief. 1. Fire alarm companies that connect telephone company leased -line circuits to the Fire Department alarm center shall pay an installation charge for each panel board. This amount shall be established from time to time by resolution of the City Council. In addition, a charge established from time to time by resolution of the City Council per month per circuit shall be made of the alarm company providing the service. This charge shall be paid to the City of San Luis Obispo on the first of each month as directed by the Fire Chief. 2. Master box system (municipal fire alarm). With permission of the Fire Chief, connection to the municipal fire alarm system may be made where master box equipment is available. The minimum charge for this connection shall be established from time to time by resolution of the City Council. An additional amount established by Council resolution per year per circuit shall be charged for each subscription. Any and.all costs involved in installation, including costs of connection and any additional alarm line extensions as may be necessary, shall be paid by the subscriber. The wire shall be of approved type and size and shall be provided and installed in approved conduit by the subscriber from the facility being protected to the master box. The Fire Department shall provide the box and equipment therein and make the physical connection. 3. Unless waived by the Fire Chief, all buildings of new commercial and industrial subdivisions shall be provided with such approved underground fire alarm cable and conduit as may be required to connect to a municipal fire alarm system master box, if utilities are underground, and if such service can be provided by the Fire Department at the time of hook -up. The design of such system shall be approved by the Fire Chief prior to installation. Providing materials and installation of such underground cable and conduit shall be the responsibility of the developer and shall be tested and accepted by the Fire Chief before connection to the municipal fire alarm system. The intent of this section is to provide underground conduit and cable from all buildings until such time that an alternate method or means is provided. This is not required where alarm service is provided by means other than telephone lines. 4. Any deviation from this requirement shall be in compliance with Section 1.214." ktm 4/15/77
