HomeMy WebLinkAbout0771ORDINANCE N0. 771 (1978 Series) AN INTERIM ORDINANCE OF THE CITY OF SAN LUIS OBISPO EXTENDING URGENCY ORDINANCE NO. 792 RELATED TO THE AMENDMENT TO THE MUNICIPAL CODE TO REQUIRE A USE PERMIT FOR C -H (SERVICE - COMMERCIAL) USES ALLOWED IN M AND M/R (MANUFACTURING) DISTRICTS IN THE CITY OF SAN LUIS OBISPO FOR AN ADDITIONAL EIGHT -MONTH PERIOD. WHEREAS, the City Council adopted Urgency Ordinance No. 79 °2 on April 18, 1978, enacting emergency measures to require a use permit for C -H uses allowed in the M and M/R districts of the city so as to ensure that C -H uses conform to new standards and regulations for said uses in the M zone which were under study by the Planning Commission; and WHEREAS, the Planning Commission is still in the process of studying said standards and regulations; and WHEREAS, the City Council finds that to protect the public health, safety, and general welfare, it is appropriate to extend the interim ordinance for a period of eight (8) months, consistent with authority contained in California Government Code Section 65858; and WHEREAS, a public hearing on the extension of said ordinances was advertised and conducted by the council on Tuesday, August 15, 1978, in the Council Chambers of the City Hall, San Luis Obispo, California; NOW, THEREFORE, BE IT ORDAINED by the Council of the.City of San Luis Obispo as follows: SECTION 1. Pursuant to the provisions of Government Code Section 65858, the provisions of.Urgency Ordinance No. 79`2 are hereby extended for an additional eight (8) month period terminating April 15, 1979. SECTION 2. Staff, Planning Commission and all other appropriate advisory bodies are directed to study and develop a proposed ordinance within a reason- able time to provide for appropriate revision of the city's zoning regulations. This ordinance shall become effective immediately upon its adoption by a four - fifths vote of the council and shall remain in effect for a period of eight (8) months unless terminated sooner by the council; provided, however, that the provisions of this ordinance may be extended as provided by Government Code Section 65858. The City Clerk shall cause this ordinance to be published once within five days in a newspaper of general circulation, but delay in publication, or even failure to publish, shall not affect the validity of this ordinance.
