HomeMy WebLinkAbout0786ORDINANCE NO. 786 (1978 Series) AN INTERIM URGENCY ORDINANCE DECLARING A MORATORIUM ON THE ISSUANCE OF PERMITS FOR SIGNS WHICH INDICATE THE PRICE OF A PRODUCT OR SERVICE. WHEREAS, the City Council, to protect the public peace, health, safety and general welfare, has adopted regulations for the control of signs within the city; and WHEREAS, the adopted regulations presently allow price signing which could cause conflicts with adjoining uses and be inconsistent with the objectives of the sign regulations; and WHEREAS, Section 65858 of the California Government Code authorizes the adoption of an interim ordinance as an emergency measure in prohibiting any usage of land which may be in conflict with a contemplated zoning proposal which the legislative body, planning commission or community development depart- ment is considering or studying or intends to study within a reasonable period of time; and WHEREAS, this council finds it necessary and appropriate for the pro- tection of the public peace, health, safety and general welfare to provide interim regulations to assure that no signs are permitted pending the adoption of new regulations which may be contrary to said regulations. NOW, THEREFORE, BE IT ORDAINED by the Council of the%City of San Luis Obispo as follows: SECTION 1. Notwithstanding any provision now contained in the San Luis Obispo Municipal Code, and pursuant to Government Code Section 65858, a moratorium is hereby declared on the issuance of sign permits for signs which indicate the price of a product or service. Exceptions to this moratorium are provided in the Municipal Code for price signs for gasoline service stations and for temporary window signs. 0 786 Ordinance No. 786 (1978 Series) This ordinance is necessary to develop and maintain a pleasant and harmonious environment in the city, to promote and enhance real property values, to conserve the city's natural beauty and to preserve and enhance its distinctive visual character. This council finds that the issuance of signs permits for price signs will jeopardize these objectives. SECTION 2. No sign permit shall be issued hereafter for the erection of any sign indicating price of a product or service during the period this ordinance is in effect. SECTION 3. DECLARATION OF URGENCY. This ordinance is declared to be an ordinance for the immediate protection of the public peace, health, safety and general welfare. The facts constituting the urgency are as follows: The adoption of this ordinance on an emergency .interim basis pursuant to Section 65858 of the Government Code is based upon findings by the City Council that an emergency measure is needed to prohibit erection of any signs indicating the price of .a product or service which may conflict with a contemplated revision of the sign regulations which the City Council, planning commission and community development department are considering or studying or intend to study within a reasonable period of time. SECTION 4. EFFECTIVE DATE. This ordinance being an emergency ordinance for the immediate protection of the public peace, health, safety and welfare, containing a declaration of the facts constituting the urgency and passed by a four - fifths (4/5) vote of the council shall'take effect immediately upon its adoption and shall continue in effect for a period of no longer than four (4) months; provided, however, that after notice pursuant to Section 65856 of the Government Code and a public hearing, the council may extend the effectiveness of this interim ordinance for a period of eight (8) months. -2- Ordinance No. 786 (1978 Series) The City Clerk shall cause this ordinance to be published once within five (5) days in a newspaper of general circulation, but delay in publication or even failure to publish, shall not affect the validity of the ordinance.
