AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO
AMENDING THE OFFICIAL ZONE MAP (TO REZONE
PROPERTY AT 3301 BROAD STREET) FROM R -2 -S TO R -2 -PD
BE IT ORDAINED by the City Council of the City of San Luis Obispo as
follows:
SECTION 1. That the following described portion of the City of San Luis
Obispo as shown on the official zone map of the City of San Luis Obispo be re-
classified as follows: Said property is also shown on the map attached hereto
marked Exhibit "A" and incorporated herein by reference.
From District R -2 -S (Residential Medium Density, Special Considerations) to
R -2 -PD (Residential Medium Density, Planned Development) real property described as:
That portion of Lots 23 and 24 of the Yoakum Poultry Units, according to map
recorded March 11, 1927 in Book 3, at page 89 of Maps, and that portion of
Lot 87 of the San Luis Obispo Suburban Tract, according to map recorded
February 7, 1906 in Book 1, at page 92 of Record of Surveys, described as a
whole as follows:
Beginning at the most easterly corner of Lot 24 of said Yoakum Poultry Units
said point of beginning also being the most northerl� corner of Lot 87 of the
said San Luis Obispo Suburban Tract; thence North 32 29' west along the
northeasterly line of said lot 24, 46.35 feet to the most easterly corner of
the property conveyed to Anna K. Hansen, in deed dated August 24, 1949 and
recorded August 25, 1949 in Book 532, Page 392 of Official Records; thence
South 57031' west along the southeasterly line of the property so conveyed
498.91 feet to the northeasterly line of the right -of -way for road purposes
conveyed to the County of San Luis Obispo in deed recorded November 9, 1933
in Book 144, at Page 84 of Official Records; thence southeasterly along
said northeasterly line, the following courses and distances; south 33043'
east 119.17 feet, on a curve to the left tangent to, the last described
course with a radius of 480 feet through an angle of 25050' for a distance
of 216.42 feet and south 59037' east 181.11 feet, to the most westerly
corner of the property conveyed to Ernest Alvin Martin, et ux., in deed
dated October 4, 1946 and recorded October 4, 1946 in Book 424, Page 219
of Official Records; thence north 57031' east along the northwesterly line
of the property so conveyed to the most northerly corner thereof, said
corner also being a point on the northeasterly line of said Lot 87 of the
San Luis Suburban Tract; thence North 32029' west along the northeasterly
line of said Lot 87, 376 feet to the Point of Beginning.
EXCEPTING therefrom that Portion as described in the Final Order of
Condemnation to the State of California recorded June 21, 1976 in Book
1904, Page 637 of Official Records of San Luis Obispo County.

Approval of said rezoning is subject to the following conditions:
Conditions:
1. A total of 44 two - bedroom units shall be allowed with 2.5 on -site parking
spaces for each unit.
2. The project shall receive preliminary approval by the Architectural Review
Commission.
3. The applicant shall be given a period of six months to file a tentative
tract map and 18 months to file precise development plan for city approval.
4. The project shall be 'built -out' in a single phase. Construction shall
commence within 12 months from the date of approval of final tract map
and shall be pursued in a timely fashion.
5. The applicant shall submit draft declaration of covenants, conditions and
restrictions (CC &R's) and documents related to the creation of a homeowners'
association at the time of filing tentative tract map, for review and approval
by the Community Development Director and City Attorney. The CC &R's shall
contain the following provisions:
a. A homeowner's association to enforce the CC &R's and provide for
professional, perpetual maintenance of all common areas including
landscaping, building exteriors, private driveways, lighting, walls,
fences, etc., in first class condition;
b. A right of the City of San Luis Obispo to compel performance if the
homeowner's association fails to perform and assess the homeowner's
association for expenses: incurred;
c. No parking in private driveways except in approved designated spaces;
d. A grant to the City of San Luis Obispo the right to tow away vehicles
on a complaint basis, which are parked in unauthorized places;
e. No outside storage of boats, campers, motorhomes, trailers or inoperable
vehicles;
f. No unscreened outside storage by individual units;
g. Ownership and occupancy restrictions limiting all units to owner occupied.
6. The private driveways shall be improved to standards approved by the city
engineer.
7. All utilities shall be underground.
8. Each unit shall have individually metered water service. Meters shall be
located adjacent to driveways.
9. Water service to each unit shall be provided by extension of public mains
on private property. Sewer shall be private. Mains shall be constructed
to city standards and easements granted to the city subject to the approval
of the city engineer.
10. All grading work shall be in conformance with a soils engineer and foundation
report and the grading ordinance.
11. Applicant shall install a solid 6 -foot high fence at all property lines
except at street frontages.
12. Development shall be in accordance with the submitted preliminary plans, as
revised, and subject to further revisions to comply with city policies and
ordinances.

SECTION 2. This Ordinance, together with the ayes and noes, shall be pub-
lished once in full, at least three days prior to its final passage, in the
Telegram- Tribune, a newspaper published and circulated in said city, and the
same shall go into effect at the expiration of thrity days after its said final
passage.
INTRODUCED AND PASSED TO PRINT by the Council of the City of San Luis Obispo
at a regular meeting thereof held on the 5th. day of March 1979, on motion
of Councilman Settle seconded by Councilman Jorgensen, and on the following
roll call vote:
