AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO AMENDING THE
OFFICIAL ZONE MAP OF THE CITY TO REZONE PROPERTY AT
3023 ROCKVIEW PLACE FROM R -2 -S TO R -2 -PD (APPLICANT:
JACK FOSTER) (PD 0808)
WHEREAS, the Planning Commission and City Council have held hearings to
consider appropriate zoning for subject property in accordance with Section
65800 et seq. of the Government Code; and
WHEREAS, the City Council finds that the proposed zoning is consistent
with the General Plan; and
WHEREAS, the rezoning has been evaluated in accordance with the California
Environmental Quality Act and the City's Environmental Impact Procedures and
Guidelines and a negative declaration has been granted by the City; and
WHEREAS, the proposed zoning promotes the public health, safety and
general welfare;
WHEREAS, the council c6ncurs in the cross slope interpretation of the
Planning Commission which provides for a density entitlement of 3.51 equivalent
units; and
WHEREAS, the council finds that, on the basis of the record and testimony,
the proposed development will enhance the area in which it is proposed by
exceptional design and arrangement of buildings, provision of open space and
recreation facilities and landscaping, and the protection of the welfare and
privacy of adjoining properties. Therefore, density permitted by the R -2 zone
may be increased by 14% to a density -of 4.0 equivalent units;
BE IT ORDAINED by the Council of the City of San Luis Obispo as follows:
SECTION 1. That the areas shown on the map attached hereto marked
Exhibit "A" and included herein by reference be reclassified from R -2 -S ( Mddium -
Density Residential, Special Considerations) and A /C -40 (Agriculture Conservation)
to R -2 -PD (Medium Density Residential, Planned Development) and A /C -40 (Agriculture
Conservation), real property described as follows:

Lot 27 of Yoakum Poultry Units, in the City of San Luis Obispo,
in the County of San Luis Obispo, State of California, according
to map recorded March 11, 1927 in Book 3 at page 89 of Maps.
General Location:
3023 Rockview Place
Approval of said rezoning. is subject to the approval.of a preliminary
development plan with the following conditions:
1. The project shall receive preliminary approval by the Architectural Review
Commission.
2. The applicant shall be given a period of 12 months to file precise development
plan for city approval. Preliminary development plan approval shall become
null and void after 12 months if precise development plan is not filed and
approved.
3. The project shall be "built -out" in a single phase. Construction shall commence
within 12 months from the date of approval of a final tract map and shall be
pursued in a timely fashion.
4. The applicant shall revise the site plan showing the driveway to,city standards
with the density not to exceed 4.0 equivalent units and with no structures or
grading above the 285 foot contour elevation.
5. The applicant shall install automatic garage door openers on all garages..
SECTION 2. After review and consideration, the determination of the
Community Development Director to grant the project a negative environmental
declaration is hereby affirmed.
SECTION 3. This ordinance, together with the ayes and noes, shall be
published once in full, at least three days prior to its final passage, in the
Telegram- Tribune, a newspaper published and circulated in said city, and the same
shall go into effect at the expiration of thirty days after its said final passage.

at a meeting thereof held on the 2nd day of January, 1980 on motion of
Councilman Dunin , seconded by Councilman Bond , and on the following
roll call vote:
