HomeMy WebLinkAbout0849ORDINANCE NO. 849 (1980 SERIES) AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO AMENDING THE MUNICIPAL CODE TO ESTABLISH PRO- CEDURES FOR ISSUING DEMOLITION PERMITS FOR BUILDINGS WHICH MAY BE HISTORICALLY, ARCHITECTURALLY OR AESTHETICALLY SIGNIFICANT. WHEREAS, it is an objective of the City of San Luis Obispo to promote the preservation of architecturally significant or historically important buildings; and WHEREAS, in compliance with existing regulations, some buildings have been demolished which may have been architecturally significant or historically important; and WHEREAS, it is the desire of the City that buildings which may be historic or architecturally significant be considered for preservation prior to their demolition; and WHEREAS, preservation includes such alternates as rehabilitation and re -use of the building or moving the structure to another suitable site within the community; and WHEREAS, the City desires to provide a waiting period to allow for inves- tigation and pursuit of alternates to demolition; NOW, THEREFORE, BE IT ORDAINED'.by the City Council of the City of San Luis Obispo as follows: SECTION 1. Section 8810.1.0 of the San Luis Obispo Municipal Code (Building Regulations) is amended to read as follows: "C. Issuance 1. Requirement to Issue. If the applicant complies with the provisions of this Code and other City ordinances, the Building Official shall issue a permit for the proposed work as soon as practicable, except when a 45 -day waiting period is required by paragraph 2 below. The permit holder shall notify the department at least 24 hours before starting the work. 2. Significant Structures. a. If the structure involved is historically, architecturally or aesthetically significant, a demolition permit shall not be I Ordinance No.* 849 (19.80 Series) Page 2 t, issued sooner than -45 days after the application is filed, unless the structure poses an imminent threat to the public except the following structures shall be considered.significant for purpose of this provision: i. Any Principal buildazg (excluding Group M occupancies as defined in the UCB) . ii. Structures designated by resolution of the Council to have historic, architectural or aesthetic significance to the community. b. The City Clerk shall be notified when the city receives an application to demolish a significant structure. Within 10 days after the application is filed, the Clerk shall place a prominent display advertisement in a newspaper of general circulation to the City, announcing the application. The ad shall also include the structure's address and a vicinity map showing its location. Also within 10 days the Clerk shall notify by first -class mail, any persons or organizations that have asked to be notified of applications for..demolition of such structures. c. The 45 -day waiting period shall not apply to any significant structure which is an imminent danger to the public as defined in the Uniform Code for Abatement of Dangerous Buildings." SECTION 2. This Ordinance, together with the ayes and noes, shall be published once in full, at least three days prior to its final passage, in the Telegram- Tribune, a newspaper published and circulated in said City, and the same shall go into effect at the expiration of thirty (30) days after its said final passage.
