AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO
AMENDING THE OFFICIAL ZONE MAP TO REZONE
PROPERTY AT 251 MARGARITA AVENUE,'
BE IT ORDAINED by the City Council of the City of Sari Luis Obispo as
follows:
SECTION 1. That the following described portion of the City of San
Luis Obispo as shown on the official zone map of the City of San Luis Obispo
be reclassified as follows: Said property is also shown on the map attached
hereto marked Exhibit "A" and incorporated herein by reference.
From District R -2 -S (Residential Medium Density, Special Considerations)
to R -2 -PD (Residential Medium Density, Planned Development) real property
described as follows:
Parcel 2 of Parcel Map SLO- 78 -37, Book 26, Page 95
of Parcel Maps.
General Location:
251 Margarita Avenue
Approval of said rezoning is subject to the following conditions:
1. Applicant shall be given a period of twelve months to file precise develop-
ment plan for city approval. Preliminary development plan approval shall
become null and void after twelve months if precise development plan is not
filed and approved.
2. The project may be "built -out" in phases provided all common area improve -
ments such as driveways, guest parking, utility drainage and recreation
shall be apart of the first phase. Construction shall commence within
twelve months from the date of approval of a final tract map and shall
be pursued in a timely fashion.
3. Applicant shall soundproof the interior of the dwelling units to a 45 db
level or better, consistent with the General Plan Noise Element.
4. Applicant shall grant an avigation easement to the County of San Luis
Obispo for the entire property. Said easement shall be to the approval
of the County Airport Land Use Commission.

5. Applicant shall notify each new owner or tenant, either in writing or
in a lease that: (a) there is an airport in close proximity; (b) the
townhouses are near the flight path, and (c) the townhouses are subject
to frequent noise from aircraft passing overhead.
6. Applicant shall submit a unit identification plan with directory at each
entrance to site for approval by the Community Development Director.
7. Applicant shall group mailboxes in no more than three locations on site,
each having an alphabetical listing of occupants to the approval of
the Post Office and Community Development Director.
SECTION 2. This Ordinance, together with.the ayes and noes, shall be
published once in full, at least three days prior to its final passage, in
the Telegram - Tribune, a newspaper published and circulated in said city, and
the same shall go into effect at the expiration of thirty days after its
said final passage.
INTRODUCED AND PASSED TO PRINT by the Council of the City of San Luis
Obispo at a regular meeting thereof held on the 15th day, of April, 1:980,
on motion of Councilman Bond , seconded by Councilwoman Billig ,
and on the following roll call vote:
AYES: Councilmembers Bond, Billig, Dunin and Munger
NOES: None
ABSENT: Mayor Lynn R. Cooper
the foregoing resolution was passed and adopted this 15th day of April,
1980.
