HomeMy WebLinkAbout08864, ORDINANCE NO. 886 (1981 Series) AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO AMENDING SECTION 4289 OF THE SAN LUIS OBISPO MUNICIPAL CODE TO PROHIBIT THE OPERATION OF MOTOR VEHICLES ON THE UNIMPROVED PORTIONS OF ` PRIVATE PREMISES WITHOUT THE OWNER'S PERMISSION BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. Section 4289 of the San Luis Obispo Municipal Code hereby is amended to read as follows: "SECTION 4289. REGULATION:OF'VEHICLE USE UPON PRIVATE PROPERTY (a) No person shall drive .a motor vehicle for recreational, sporting or competitive activities upon the unimproved portions of any lands belonging to or occupied by another without having and, upon request of a peace officer, displaying written permission from the owner of such lands or his agent, or the person in lawful possession thereof. (b) If a person arrested or cited for a violation of this ordinance has been arrested or cited by the Police Department for a previous violation of the ordinance within the preceding twelve -month period, the arresting.officer shall impound the vehicle or device involved in the violation. The owner of said vehicle or device may reclaim it upon proof satisfactory to the Chief of Police (1) that it will not be so unlawfully used in the future, or (2) that the previous arrest or citation was invalid or erroneous. (c) For the first vehicle impounded under this ordinance for any owner, the written representations of the adult owner, or the parents of a juvenile owner, that the vehicle will not be so used again shall be deemed to be 'proof satisfactory.' Any person dissatisfied with a ruling of the Chief of Police may appeal said ruling directly to the Council. SECTION 2. This Ordinance, together with the ayes and noes, shall be published once in full, at least three (3) days prior to its final passage in the Telegram- Tribune, a newspaper published and circulated in said City, and the same shall go into effect at the expiration of thirty (30) days after its said final passage. 0 886 S R ' . t ORDINANCE NO. 886 (1981 Series) INTRODUCED AND PASSED TO PRINT by the Council of the City of San Luis Obispo at a meeting held on the 14th day of _P'Say 1981, on motion of Councilman Settle seconded. by Councilwoman Dovey , and on the following roll call vote: AYES: Councilmembers .Settle.
