HomeMy WebLinkAbout0889ORDINANCE NO. 889 (1981 Series) ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN LUIS OBISPO AMENDING CERTAIN PROVISIONS OF ARTICLE VIII, ( "DEMOLITION AND MOVING OF BUILDINGS "), OF THE SAN LUIS OBISPO MUNICIPAL CODE. BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. Section 8800.11 of the San Luis Obispo Municipal Code hereby is amended to add the following sentence to Except A thereof: Provided that if the building is less than 20 feet from public property lines, adequate protection shall be provided for pedestrians and public property, to the satisfaction of the Building Official. SECTION 2. Section 8810.1.E of the San Luis Obispo Municipal Code hereby is amended to make plural the word EXCEPTION, i.e., "EXCEPTIONS ", number the current exception "1" and add the following two exceptions: 2. On single -story structures not exceeding 500 square feet, the Building Official may reduce the amount of the cash bond to $250.00. 3. No bond will be required where the demolition is permitted as part of a redevelopment project. SECTION 3. Subsection C of Section 8810.1 of the San Luis Obispo Municipal Code hereby is amended to read as follows: C. Procedure for Processing Applications for Demolition Permits. Upon receipt of an application for a demolition permit, the Building Official shall refer the application to the Architectural Review Commission for placement on their next open agenda. 1. Nonsignificant Structures. If the demolition project is not in conjunction with a replacement project and the ARC cannot determine any historical, architectural or aesthetic significance to the community, the ARC shall refer the matter back to the Building Official with direction-to issue the demolition permit. The demolition permit shall be effective on date of issue. 2. Significant Structures. If the structure to be demolished is determined by the ARC to have historic, architectural or aesthetic significance to the community, the ARC shall direct the applicant to submit plans for ARC revfew pursuant to Subsection 3, below.. W:: • Ordinance No. 889 (1981 Series) Page 2 r_ Upon ARC's determination that an application to demolish involves a significant structure, the Building Official shall notify the City Clerk, who, within ten (10) days after notification, shall place an advertisement in a newspaper of general circulation in the city, announcing the proposed demolition. The ad shall show the location of the structure on a vicinity map with the street address. The City Clerk shall also, within the aforementioned ten (10) days, notify by first -class mail, any persons or organizations that have asked to be notified of applications for demolition permits. 3. Findings Required. When a significant structure is proposed for demolition, plans for its replacement shall be submitted to the Architectural Review Commission for review and approval prior to the issuance of a demolition permit. The ARC must determine that the proposed replacement structure is as, or more, compatible with neighboring development than the existing structure, consistent with ARC guidelines. Upon making this determination, the ARC will direct the Building Official to issue the demolition permit. If this determination cannot be made, the demolition permit shall not be issued. 4. Exceptions. Upon determination by the Building Official that the structure to be demolished is a dangerous building, as defined in the Uniform Code for the Abatement of Dangerous Buildings, the Building Official may, with the Community Development Director's concurrence, issue the demolition permit without the above ARC review and findings. Accessory buildings, sheds, garages and similar buildings will not need ARC review. If it is necessary to maintain any power, water, or other lines during demolition or moving, such lines shall be temporarily relocated or protected to the satisfaction of the Construction Regulations Division and utility agency and in accordance with all applicable ordinances. SECTION 8800.14. License Reauirements. Contractors engaged in demolition and moving work within the City of San Luis Obispo shall have a valid California State Contracting License and a City business license. All building moving operations and demolition of all buildings except one and two story wood frame, and and two family residential buildings, shall be accomplished by State licensed contractors. One and two story wood frame, one and two family residential buildings may be demolished by the owner thereof. PART I - DEMOLITION OF BUILDINGS SECTION 8810.1. Demolition Work. A. Permit Required. The work of demolishing any building or structure shall not commence until a permit has been issued by the Building Official in accordance with the provisions set forth in other portions of this Code. B. Application for Permit. All applications for permits to wreck, demolish, or raze a building or structure shall be made to the Build- ing Official and every application shall state: 1. The precise location of the building or structure to be wrecked. 2. The type of equipment to be used to wreck said building. 3. The length, width, height and principal materials of con- struction of the building. 4. The length of time required to complete the proposed work. 5. The name and address of the owner(s) of the building,. 6. Proof of permission from the owner(s) and other vested interests to do the proposed work. 7. Method (s) of demolition. C.- Issuance. 1. Requirement to Issue. If the applicant complies with the provisions of this Code and other City ordinances, the Building Official shall issue a permit for the proposed work as soon as l0 practicable, except when a.45 -clay waiting period is required by (�Yeast aragraph 2 below. Within 1.0 days after the application is filed, the Clerk shall place a prominent display advertisement in a newspaper of general circu- lation to the City, announcing the application. The ad shall also include the structure's address and a vicinity map showing its location. Also within 10 days the Clerk shall notify by fi_rst.•- class mail, any persons or organizations that have asked to he notified.of applications for demolition of such structure,. C.
