-AN INTERIM URGENCY ORDINANCE OF THE CITY OF SAN LUIS
OBISPO IMPOSING A MORATORIUM IN THE CONVERSION OF
MOBILE HOME PARKS TO STOCK COOPERATIVES, CONDOMINIUMS,
PLANNED DEVELOPMENTS OR OTHER FORMS OF SUBDIVIDED INTERESTS
BE IT ORDAINED by the Council of the City of San Luis Obispo as follows:
SECTION 1. Subdivision Moratorium. Pending study and public hearings
regarding the subdivision of mobile home parks, this council hereby establishes
the following moratorium measures:
A. During the effective period of this ordinance, the city shall not
approve or accept any applications for the subdivision of mobile home
parks into condominiums, stock cooperatives, planned developments or
any other form of subdivided ownership interests.
B. This ordinance shall be effective from the date of its passage through
October 31, 1981.
SECTION 2. Urgency. This ordinance is declared to be an ordinance for the
immediate protection and preservation of the public peace, health and welfare.
Facts in support of the urgency of this ordinance are as follows:
A. Because of the great demand for mobile home park rental spaces and the
short supply of same, rent charges for those spaces are escalating
rapidly.
B. The increased rents in turn greatly increase the value of the property,
creating incentive to subdivide mobile home parks and sell the spaces
to those who can afford them.
C. Any such subdivision proposal or project could adversely affect the
supply of rental housing available in the city, and further, result in
the displacement of many mobile home space tenants who would be unable
to purchase their own spaces at the anticipated prices.
D. This council desires to undertake a study to assure that any such
subdivision is appropriately regulated in with city law.
E. The council estimates that three to five months will be needed to make
the study and to adopt appropriate legislation, if any.

F. Pending the study, it is in the best interests of a significant number
of the residents of the city to, impose the urgency moratorium contained
herein.
SECTION 3. Effective Period. This ordinance being an emergency measure for
the immedite protection and preservation of the public peace, health and welfare,
containing a declaration of the facts constituting the urgency and passed by four
affirmative votes of the Council shall take effect immediately pursuant to
Charter Section 605 and shall continue in effect through October 31, 1981.
SECTION 4. Publication. The City Clerk shall cause this ordinance to be
published within five days in a newspaper of general circulation, but delay in
publication or even failure to publish, shall not affect its validity.
SECTION 5. Rescission. This ordinance may be rescinded by the City Council
at any time by affirmative vote of at least three members of the Council.

at a meeting held on the 16th day of June, 1981, on motion of Councilman Settle
, seconded by Councilman Dunin , and on the following roll
call vote:
