HomeMy WebLinkAbout0893W ORDINANCE NO. 893 (1981 Series) AN ORDINANCE AMENDING THE SAN LUIS OBISPO MUNICIPAL CODE TO CREATE UNDERGROUND UTILITY DISTRICT NO. 9/10 AND FIXING THE DATES FOR CONVERSION AND CONNECTION THERETO BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: The San Luis Obispo City Council does hereby order the removal of all poles and overhead wires and associated structures from the public streets, alleys or ways within the hereinafter described underground utility district and further fixes dates on which affected property owners must be ready to receive underground service and dates on which all facilities are to be removed from public property. SECTION 1. Pursuant to public hearings duly held in accordance with Section 8400.2 of the San Luis Obispo Municipal Code; .Section 8400.2.1 of said Code entitled "Underground Utility Districts" is hereby amended to add Subsection 9, District No. 9/10, as set forth below: 9. Beginning at the northernmost corner of Block 6 of Murray and Church addition to the City of San Luis Obispo at the intersection of Broad and Marsh Streets, and following the northeasterly boundary of said block southeasterly thirty feet to the true point of beginning, thence northwesterly along the northeasterly boundaries of Blocks 69 7 & 8 of Murray and Church addition to a point on the northwestern side of Monterey Street, thence southwesterly along the northwesterly side of Monterey Street to a point across Nipomo Street on the southwesterly side of Nipomo Street, which is the northeasterly boundary of Block 61 in the McDougall Tract, thence southeasterly along the southwesterly side of Nipomo Street, a distance of approximately 160', thence in.a southwesterly direction, on a line parallel to Higuera Street, a distance of approximately 750' to the intersection of San Luis Obispo creek. Said parallel line to be 200' 0 893 r'" ORDINANCE NO. 893 (1981 Series) Page 2 May 20, 1981 northwesterly of the northwestern side of Higuera Street. Upon intersection with San Luis Obispo creek, thence following the centerline of said creek to Cal Trans bridge at the Marsh /Higuera Streets on /off ramp, thence southeasterly across the on /off ramp accessway to the westerly side of Higuera Street, thence on a straight line across Higuera Street in a northeasterly direction to the true point of beginning. Said straight line to be 30' southeast of and parallel to the southeastern side of Marsh Street. Property owners are to be ready to receive service by November 1, 1982. Date facilities are to be removed from public property: May 1, 1983. SECTION 2. The City Council does hereby find that the public necessity, health and safety require the removal of all poles and overhead wires and associated overhead structures from the public streets, alleys or ways within the area described in Subsection 9 of Section 8400.2.1 as amended above, and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service therein. The Council also finds that the streets within said area hereafter known as Underground Utility District No. 9/10 are heavily travelled and extensively used by the public. SECTION 3. Within ten (10) days after the effective date of this ordinance, the City Clerk shall notify all affected utilities and all persons owning real property within or affected by the District created by this ordinance of the adoption thereof. Said City Clerk shall further notify such affected property owners of the necessity that, if they or any person occupying such property desire to continue to receive electric, communication, or similar or associated service, they or such occupant shall provide all ORDINANCE NO. 893 (1981 Series) Page 3 May 20, 1981 necessary facility changes,on their premises so as to receive such service from the lines of the supplying utility or utilities at a new location, subject to applicable rules, regulations and tariffs of the respective utility or utilities on file with the Commission and to the requirements of State laws and City ordinances. Notification by the City Clerk shall be made as set forth in Section 8400.6, of the San Luis Obispo Municipal Code. SECTION 4. This Ordinance, together with the ayes and noes, shall be published once in full, at least three days before its final passage, in the Telegram- Tribune, a newspaper published and circulated in said City, and, the same shall go into effect at the expiration of thirty (30) days after its said final passage.
