ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN LUIS OBISPO
AMENDING CERTAIN PROVISIONS OF CHAPTER 5 OF THE SAN LUIS OBISPO
MUNICIPAL CODE (ARCHITECURAL REVIEW COMMISSION) TO PROVIDE FOR
ARC REVIEW OF CERTAIN SINGLE- FAMILY DWELLINGS, TO CLARIFY APPEALS
RIGHTS, AND TO REVISE TERMS OF APPOINTMENT
BE IT ORDAINED by the Council of the City of San Luis Obispo as
follows:
SECTION 1. Subsection (D) of Section 9500.1 of the San Luis Obispo
Municipal Code is hereby amended to read as follows:
(D) "Director" shall mean the Community Development Director, or someone
designated by him,to act on his behalf.
SECTION 2. Section 9500.02 General Provisions is hereby renumbered to
Section 9500.2.
SECTION 3. Subsection k (3) of Section 9500.02 of the San Luis Obispo
Municipal Code is hereby amended to read as follows:
(3) Term of Office:
Commissioners shall be appointed for terms of two (2) years which shall,
commence immediately upon appointment by the City Council
Commissioners shall serve at the pleasure of the City Council and may
be reappointed; provided that no appointee shall serve more than four
(4) consecutive full terms (eight (8] years). Appointment to a partial
term of office following an unscheduled vacancy shall not preclude the
appointee from serving four consecutive full terms following completion
of the partial term, provided that the partial term is less than one
year.
SECTION 4. References in Chapter 5, Section 9500.1 through 9500.3 "Planning
and Building Department" are hereby amended to read "Community Development
Department."
SECTION 5. Referenced in Chapter 5, Section 9500.1 through 9500.3 to
"Planning Director" are hereby amended to read "Director."
SECTION 6. Subsection (E) of Section 9500.2 of San Luis Obispo Municipal
Code is hereby amended to read as follows:

(E) Jurisdiction. Approval by the commission shall be required for all
structures and physical improvements except individual built
single - family dwellings. The exception for the individual
single - family dwellings shall not apply if (1) architectural review is
required as a condition of a subdivision, use permit or other
discretionary entitlement; (2) when a developer proposes to construct
three or more units; (3) when the director determines the site is
sensitive as set forth in the Procedures Document. Sensitive sites
shall include, but not be limited to, open space zoning areas as
applied to steep terrain and waterways, and any other areas designated
by resolution of the Planning Commission, Architectural Review
Commission or City Council; and (4) where the scale or character of the
proposed dwelling contrasts significantly with adjacent or neighboring
structures. The commission shall also review all city financed
projects, including, but not limited to, municipal buildings, park and
open spaces and street furniture.
SECTION 7. Subsection (F) of Section 9500.2 of San Luis Obispo Municipal
Code is hereby amended to read as follows:
(F) Appeals. The applicant may file an appeal to the City Council on any
ruling of the Architectural Review Commission within ten (10) calendar
days of the Commission's action. Appeals shall. set forth in detail
reasons for the appeal including alleged inconsistencies or
non - conformity with procedures or criteria set forth in or pursuant to
this code. A public hearing shall be held upon the appeal at the
earliest available regular Council meeting considering public notice
requirements, unless the appellant agrees to a later date. The Council
shall make its findings and conclusions no later than forty -five (45)
days after the filing of said appeal.
SECTION 8. Section 9500.01 "Miscellaneous Provisions" is hereby renumbered
at Section 9500.3.
SECTION 9. Subsection (B) (2) of Section 9500.3 of the San Luis Obispo
Municipal Code is hereby amended to read as follows:
2. Architectural review approvals will automatically expire in one year
unless a different expiration date or unlimited expiration is
stipulated at the time of approval. An applicant may at any time apply
to the Director for an extension of up to one year; provided that
approval not exceed a maximum of two years from the date of original
approval. The director may grant the extension if he finds that there
has been no substantial change in the factual circumstances surrounding
the originally approved design. The director may make minor
modifications of the approved design at the time of extension. Any
further extension beyond two years from the date of original approval
shall require submission of a new application for Architectural Review
Commission approval..
