HomeMy WebLinkAbout0901ORDINANCE NO. 901 (1981 Series) AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO TO ESTABLISH PERMIT REQUIREMENTS FOR THE CONVERSION TO NON- RESIDENTIAL USE OF HOUSING IN PORTIONS OF THE CENTRAL BUSINESS DISTRICT WHEREAS, the City Council submitted a Block Grant Application to the federal Department of Housing and Urban Development (HUD) in 1980 requesting funds to set up a downtown housing rehabilitation program; and . WHEREAS, HUD has approved the city's grant application and has made available $350,000.00 to carry out a downtown rehab program; and WHEREAS, as part of the approved CDBG grant application the city said that it would establish a "conversion permit" process which the intent of would "...be to limit downtown conversions and require that landlords help relocate their tenants when the city does approve the conversion of existing housing. "; and WHEREAS, the Planning Commission and City Council has reviewed at public hearings a draft Conversion Ordinance prepared by the staff and have considered the pros and cons•of such an ordinance; and WHEREAS, after review and consi.derati:on, the determination of the Community Development Director to grant the project a negative declaration is Hereby affirmed. BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. Chapter 9, Section 9900 is hereby added to Article IX of the San Luis Obispo Municipal . Code, as follows: 0 901 Ordinance No. 901 Page 2 DOWNTOWN HOUSING CONVERSION PERMITS 9900 PURPOSE AND INTENT It is the desire of the city to retain housing in the central business district. It is also the intent of the City that this housing should provide shelter for low and moderate income people and senior citizens. The provisions of this section are intended to achieve these goals by regulating the conversion of downtown housing to non - residential uses. 9901 AREA OF APPLICATION Provisions of this section shall apply to certain types of residential land uses within portions of the downtown shown in Figure 1. 9902 LAND USES AFFECTED Provisions of this section shall apply to all residential land uses which contain four (4) or more dwelling units and to all hotels, motels or boarding houses which have four or more individual rooms for rent. 9903 PERMIT REQUIRED Before any residential land uses regulated by this section are converted to non - residential use, a conversion permit must be approved by the City Council. 9904 PUBLIC HEARINGS'AND NOTICE Prior to acting on applications, the City Council shall hold a public hearing, notice of which shall be given tenants of the proposed conversion and posted on the property at least ten days beforehand. 9905 " FINDINGS In order to grant a conversion permit, the City Council must find that approval of the permit is consistent with the adopted San Luis Obispo General Plan and the adopted Downtown Goals Statement. 9906 CONDITIONS'OF APPROVAL The City Council may establish conditions of approval which provide, 'for the general health, safety and welfare of tenants displaced by the proposed conversion in conformity with the following:. .v Ordinance No. 901 Page 3 a. 0 Vacation of Unit - each tenant shall have the right to remain not less than 60 days from the date of Council approval of a conversion permit. The City Council may grant an extensionof this right to remain for a period of time not "to exceed an additional 30 days. No Increase in Rent - a tenant's rent shall not be increased during the period provided in "a" above.
