AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO AMENDING
THE OFFICIAL ZONE MAP TO REZONE PROPERTY AT 271 BRIDGE
STREET FROM C /OS -40 AND M to C /OS -5
WHEREAS, the Planning Commission and City Council have held hearings to
consider appropriate zoning for subject property in accordance with Section 65800
et. seq. of the Government Code; and
WHEREAS, the City Council finds that the proposed zoning is consistent with
the General Plan; and
WHEREAS, the rezoning has been evaluated in accordance with the California
Environmental Quality Act and the City's Environmental Impact Procedures and
Guidelines and a negative declaration has been granted by the city; and
WHEREAS, the proposed zoning promotes the public health, safety and general
welfare; and
WHEREAS, the proposed zoning shall become effective upon recordation of an
open space easement as shown on Attachment 1 and Attachment 2 and included herein
by reference to be approved by the Council or in 30 days after final passage of
the ordinance, whichever comes last, providing that said approval shall become
null and void if the proposed zoning does not become effective within 6 months
from final passage of this ordinance;
BE IT ORDAINED by the Council of San Luis Obispo as follows:
SECTION 1. That the area shown on the map attached hereto marked Exhibit
"A" and included herein by reference be reclassified from C /OS -40
(conservation /open space -40 acre mimimum) and M (industrial) to C /OS -5
(conservation /open space -5 acre minimum).

SECTION 2. This ordinance, together with the ayes and noes, shall be
published once in full, at least three (3) days prior to its final passage, in
the Telegram- Tribune, a newspaper published and circulated in said city, and the
same shall go into effect at the expiration of thirty (30) days after its said
final passage or upon filing of the easement.
INTRODUCED AND PASSED TO PRINT by the Council of the City of San Luis Obispo
at a meeting thereof held on the 17th day of November, 1981 on motion of
Councilman Dunin seconded by Councilwoman Dovev , and on the following
roll call vote:
AYES: Councilmembers Dunin, Dovey, Griffin, Settle and Mayor Billig
NOES: None
ABSENT: None

OPEN SPACE EASEMENT REQUIREMENTS
The open space easement will be to maintain the area in a natural open space
character. The easement shall run with the land and provide the following
limitations on use or alterations of the area:
a. No structures will be placed or erected on said premises.
b. Fencing appropriate to open space preservation shall be approved by the
Architectural Review Commission.- Solid fencing shall not be allowed.
c. No advertising of any kind or nature shall be located on or within said
premises.
d. Owner shall not plant, nor permit to be planted, any vegetation upon said
premises, except for erosion control, fire protection and soil stabilization
or as allowed and approved by the Community Development Director.
e. The general topography of the area including existing road shall be preserved
in its natural or existing condition. No grading shall be allowed except
as permitted by the Community Development Director for agricultural purposes.
f. No extraction of natural resources except for water.
g. No removal of natural vegetation except for fire protection or elimination
of diseased growth, as approved by the Community Development Director.
