HomeMy WebLinkAbout0913ORDINANCE NO. 913 (1981 Series) AN ORDINANCE OF THE CITY OF SAN LUIS OBIPSO AMENDING THE OFFICIAL ZONE MAP OF THE CITY TO REZONE PROPERTY AT 455 BRIZZOLARA STREET FROM R -1 -S TO R -1 -PD (APPLICANT: LEO EVANS) (PD 1003) WHEREAS, the Planning Commission and City Council have held hearings to consider appropriate zoning for subject property in accordance with Section 65800 et. seq. of the Government Code; and WHEREAS, the City Council finds that the proposed zoning is consistent with the General Plan; and WHEREAS, the rezoning has been evaluated in accordance with the California Environmental. Quality Act and the City's Environmental Impact Procedures and Guidelines and a mitigated negative declaration has been granted by the city; subject to the following mitigation measures being incorporated into the project: 1. All residential units shall be provided with exterior walls with STC ratings to provide a maximum noise level of 45 Ldn on the interior of the units. 2. Any work in the creek area will require a permit from the State Department of Fish and Game. 3. Tree Committee approval shall be obtained for the removal of three walnut trees on -site and specimen trees no smaller than 24 inch box shall be planted as part of the landscape plan for the project as compensation for tree removal. WHEREAS, the proposed zoning promotes the public health, safety and general welfare of persons living or working in the vicinity; and WHEREAS, the Planned Development preliminary plan transfers allowable development within the site from areas of greater environmental sensitivity and hazard to areas of less sensitivity and hazard; and WHEREAS, features of the Planned Development preliminary plan design, such as privacy, usable open space, adequate parking, noise mitigation, and compatibility with the neighborhood character, achieve the intent of conventional standards as well as or better than the standards themselves; and 0 913 Ordinance No. 913 (1981 Series) PD 1003 Page 2 WHEREAS, the City Council has reviewed and considered the application, staff report, Planning Commission recommendation, and other materials included in the December 1, 1981 agenda packet relative to this matter, and on the basis of various comments made during the hearing on this matter, finds that the proposed development will. enhance the area in which it is proposed; is of good design; provides open space and landscaping; and protects the welfare and privacy of adjoining properties. BE IT ORDAINED, by the Council of the City of San Luis Obispo as follows: SECTION 1. That the areas shown on the map attached hereto marked Exhibit "A" and included herein by reference be reclassified from R -1 -S (Low- density Residential, Special Considerations) to R -1 -PD (Low - density Residential, Planned Development), real property described as follows: Lots 17, 18 and 19 of the Brizzolara Addition to the City of San Luis Obispo, in the County of San Luis Obispo, State of California. General Location: 455 Brizzolara Street SECTION 2. Approval of said rezoning is subject to the approval of a prelininary development plan with the following conditions: 1. Applicant shall combine three underlying lots into one lot by way of a minor subdivision. 2. Applicant shall construct and dedicate hammerhead turnaround, consistent with approved plan, to the approval of Public Services Department staff. 3. Applicant shall submit precise development plan for approval. of city Architectural Review Commission. 4. Common driveway shall be marked and posted for no parking at any time to the approval of the city Fire Department. 5. Applicant shall record a common driveway agreement consistent with Parking and Driveway Standards. Ordinance No. 913 (1981 Series) PD 1003 Page 3 6. Applicant shall request abandonment of the portion of Brizzolara Street right -of -way from northerly project driveway to southerly terminous of said right -of -way. 7. Applicant shall extend 10 inch water main in easement granted to the city to the south site boundary line to the approval of the city Utilities Engineer (recommended that applicant apply for city participation). 8. Applicant shall grant to the city, creek maintenance and improvement easement to allow for possible future creek widening, consistent with creek setback line, according to city policies to the approval of the City Engineer., 9. Project shall be "built -out" in one phase. 10. Applicant shall pave a portion of Brizzolara Street 20 feet wide from end of existing pavement to the subject site to the approval of the Public Services Department. 11. Applicant shall install address directory board at the project entrance subject to the approval of the Architectural Review Commission and Community Development Department staff. 12. Mail boxes shall be clustered at the pedestrian entrance to the approval of the Architectural Review Commission and Community Development staff. 13. All public improvements indicated on the approved preliminary development plan site plan shall be completed by the applicant as a part of the development. 14. Precise development plan shall be approved by the Community Development Director within one year. Preliminary development plan approval shall become null and void after one year if precise development plan is not filed and approved. Development shall commence within six months after precise development plan approval. 15. Applicant shall install individual water meters clustered in a location to approved by the Public Services Department staff. SECTION 3. This ordinance, together with the ayes and noes, shall be published once in full, at least three days prior to its final passage, in the Telegram- Tribune, a newspaper published and circulated in said city, and the same shall go into effect at the expiration of thirty days after its said final passage.
