AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO
AMENDING MUNICIPAL CODE SECTION 3211.1, 3211.2
3211.3,.AND DELETING SECTION 3211.4 REGARDING
LOADING ZONES.
BE IT ORDAINED by the Council of the City of San Luis Obispo as
follows:
SECTION 1. Section 3211.1, 3211.2, and 3211.3 of the San Luis Obispo
Municipal Code is hereby amended to read as follows below.
SECTION 2. Section 3211.4 of the San Luis Obispo Municipal Code is
deleted and left blank as follows below:
SECTION 3211.1 CURB MARKINGS TO INDICATE NO STOPPING AND PARKING
REGULATIONS.
(a) The city traffic engineer is hereby authorized, subject to the
provisions and limitations of this chapter, to place, and when required
herein shall place, the following curb markings to indicate parking or
standing regulations, and said curb markings shall have the meanings as
herein set forth.
(1) Red shall mean no stopping, standing or parking at any time
except as permitted by the Vehicle Code, and except that a bus may
stop in a red zone marked or signed as a bus zone.
(2) Yellow shall mean no stopping, standing or parking at any
time between 7:00 a.m. and 5:00 p.m. of any day except Sunday and
holidays for any purpose other than the commercial loading or
unloading of materials (Ordinance No. 748 - 1978 Series).
(3) White shall mean no stopping, standing or parking for any
purpose other than loading or unloading of passengers, or for the
purpose of depositing mail in an adjacent mail box, which shall not
exceed three (3) minutes and such restrictions shall apply between
7:00 a.m, and 6:00 p.m. of any day except Sundays and holidays and
except as follows:
(a) When such zone is in front of a hotel or in front of a
mailbox the restrictions shall apply at all times.
(b) When such zone is in front of a theatre the
restrictions shall apply at all times except when such theatre is
closed.
(4) When the city traffic engineer as authorized under this
chapter has caused curb markings to be placed, no person shall stop,
stand or park a vehicle adjacent to any such legible curb
markings in violation of any of the provisions of this section.
SECTION 3211.2 EFFECT OF PERMISSION TO LOAD OR UNLOAD IN YELLOW ZONE.
(a) No person shall stop, stand or park a vehicle in any yellow loading
zone for any purpose other than loading or unloading material for such time as
is permitted in this section.
(b) The loading or unloading of materials shall be allowed only for those
deliveries made by commercially registered vehicles used for commercial
business deliveries: also the delivery or pickup of express and parcel post
packages and United States mail. Passenger vehicles may not use a loading zone
for any purpose except when the zone is not effective. (Ordinance No. 748 -
1978 Series.)
(c) Permission herein granted to stop or stand a vehicle for the purpose
of loading or unloading materials shall not extend beyond the time necessary
therefore, and in no event for more than thirty (30) minutes. Evidence that
there was no activity involving the loading or unloading of materials into or
from a vehicle during any continuous period of time of five (5) minutes or
longer shall ,constitute prima facie evidence that said vehicle was parked
longer than the time necessary for loading or unloading.
SECTION 3211.3 EFFECT OF PERMISSION TO LOAD OR UNLOAD IN WHITE ZONES.
(a) No person shall stop, stand or park any vehicle in any passenger
loading zone or any vehicle other than a taxicab in a specially marked loading
zone for any purpose other than the loading or unloading of passengers for such
time as is specified in this Section.
(b) Permission herein granted to stop or park for purposes of loading or
unloading passengers shall include the loading or unloading of personal baggage
and shall not extend beyond the time necessary therefore and in no event for
more than three (3) minutes.
(c) The City Council may, by resolution, allow taxicabs to stand in
specially marked passenger loading zones and regular parking spaces for
extended periods of time providing the driver is present in the cab.
(d) Within the total time limits above specified the provisions of this
section and Section 3211.2 shall be enforced so as to accommodate necessary and
reasonable loading or unloading but without permitting abuse of the privileges
hereby granted.
SECTION 3211.4
SECTION 3. The Ordinance, together with the ayes and noes, shall be published
once in full, at least three (3) days prior to its final passage in the
Telegram Tribune, a newspaper published and circulated in said City, and the
same shall go into effect at the expiration of thirty (30) days after its final
passage.
INTRODUCED AND PASSED TO PRINT by the Council of the City of San Luis
Obispo at a meeting held on the 1 st day of June 1982, on
motion of Councilman Settle , seconded by Councilman Dunin
and on the following roll call vote:
AYES: Councilmembers Settle, Dunin, Dovey and Mayor Billig
