ORDINANCE NO. 928 (1982 Series)
AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO AMENDING
SECTIONS 4506(e), 4511(b), 4516 and 4520 OF THE
SAN LUIS OBISPO MUNICIPAL CODE AND ADDING SECTION
4522 OF THE SAN LUIS OBISPO MUNICIPAL CODE (BINGO
REGULATIONS) TO CONFORM THE CITY ORDINANCE WITH
AMENDMENTS TO STATE LAW.
BE IT ORDAINED by the Council of the City of San Luis Obispo as follows:
SECTION 1. Section 4506(e) of the San Luis Obispo Municipal Code is
hereby amended to read as follows:
"Section 4506(e).
A statement by the applicant that the property described in subsection
(d) is (i) owned by the applicant, or is leased by the applicant, or the
use of the property has been donated to the applicant and (ii) that said
property is used by the applicant for an office or for the performance of
the purposes for which the applicant is organized;"
SECTION 2. Section 4511(b) of the San Luis Obispo Municipal Code is amended
to read as follows:
"Section 4511(b).
A portion of such proceeds, not to exceed 20 percent of the proceeds before
the deduction for prizes, or $1,000.00 per month, whichever is less,
may be used for rental of property, overhead, including the purchase of
bingo equipment, administrative expenses, security equipment, and security
personnel."
SECTION 3. Section 4516 of the San Luis Obispo Municipal Code is amended
to read as follows:
"Section 4516. Where Bingo Games Maybe Conducted.
A licensee shall conduct a bingo game only on property owned or leased by
it, or on property the use of which is donated to the licensee, and which
property is used by such organization for an office or for performance of
the purposes for which the organization is organized. Nothing in this

section shall be construed to require that the property owned or leased
or used by the organization be owned or leased or used exclusively by such
organization. The license issued under this chapter shall authorize the holder
thereof to conduct bingo games only on such property, the address of which is
stated in the application. In the event the described property ceases to be
used as an office or as a place for performance of the purposes for which the
licensee is organized, the license shall have no further force or effect.
A new license may be obtained by an eligible organization, upon application
under this chapter, when it again owns or leases property, or uses property
that is donated to the licensee, for an office or for performance of the
purposes for which the organization is organized."
SECTION 4. Section 4520 of the San Luis Obispo Municipal Code is hereby
amended to read as follows:
"Section 4520. Receipt of Profits by a Person a Misdemeanor Under
State Law.
It shall be a misdemeanor under Section 326.5(b) of the Penal Code of the
State of California for any person to receive a profit, wage, or salary
from any bingo game authorized under this Chapter; provided, security
personnel employed by the licensee may be paid from the revenues of
bingo games subject to the limitations specified in Section 4511(b) of
this Code., A violation of this Section is punishable by a fine not to
exceed $10,000.00, which fine shall be deposited in the general fund of
the City."
SECTION 5. Section 4522 is hereby added to the San Luis Obispo Municipal
Code to read as follows:
"Section 4522. Percentage of Cross Receipts to be Used Only for
Charitable Purposes.
If the monthly gross receipts from bingo games conducted by a licensee
exceed $5,000.00, 10% of the proceeds shall be used only for charitable
purposes not relating to the conducting of bingo games;-the balance shall

be used for prizes, rental of property, overhead, administrative expenses
and payment of license fee, subject to the limitations specified in Section
4511(b) of this Code."
SECTION 6. This Ordinance, together with the Ayes and Noes shall be published
once in full at least three.(3) days prior to its final passage in the Telegram
Tribune, a newspaper published and circulated in said City, and the same shall go
into effect at the expiration of thirty (30) days after its said final passage.
INTRODUCED AND PASSED TO PRINT by the Council of the City of San Luis Obispo
at a meeting held on the 15th day of June , 1982, on motion of Councilman
Griffin , seconded by Councilman Dunin and on the
following roll call vote:
AYES: Councilmembers Griffin, Dunin, Dovey and Mayor Billig
NOES: None
ABSENT: Councilman Settle
