HomeMy WebLinkAbout09331 ORDINANCE NO. 933 (1982 S__a ES) AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO AMENDING THE OFFICIAL ZONE MAP TO REZONE PROPERTY AT 2877 BROAD STREET FROM R -1, R -2, and A /C -40 to R -1 7PD ( "CHEAPSKATE HILL ") AND AMENDING BY SUPERSEDING ORDINANCE-N0. 871 (1980 SERIES) APPLICANT: JOHN KING, PD 0890) WHEREAS, the Planning Commission and City Council have held hearings to consider appropriate zoning for subject property in accordance with Section 65800 et. sect. of the Government Code; and WHEREAS, the City Council finds that the proposed zoning is consistent with the General Plan; and WHEREAS, the rezoning has been evaluated in accordance with the California Environmental Quality Act and the City's Environmental Impact Procedures and Guidelines and the City Council concurs with the Community Development Director's actions to grant a mitigated negative declaration with mitigation measures as follows: 1. All proposed housing units shall be built below the gravity flow water services limit. 2. Only proposed house elevations A through E will be built on the lots abutting Lawrence Drive to mitigate..aesthetic concerns. 3. Solar access shall be preserved for all lots to the maximum extent possible. 4. Drainage easement and improvements along the Lawrence Drive neighborhood shall be per s- taff's September 10, 1980 mitigated negative declaration memo and subject to the City, Engineer's approval. WHEREAS, the City Council finds that the proposed development will enhance the area in which it is proposed by exceptional design and arrangement of lots; buildings, provision of open space and recreation facilities and landscaping and the protection of the welfare and privacy of adjoining properties; and WHEREAS, the proposed zoning promotes the public health, safety and general welf are; 0 933 Ordinance No. 933 # (1982 Series) Page 2 BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. Ordinance No. 871 (1980 Series) is hereby superseded by this amended ordinance. SECTION 2. That the areas shown on the map attached hereto marked Exhibit "A" and included herein by reference be reclassified from R -1 (Residential Low Density), R -2 (Residential Medium Density) and A /C -40 (Agricultural Conservation) to R -1 -PD (Residential Medium Density Planned Development). General Location 2877 Broad Street Approval of said rezoning is subject to approval of applicant's revised tentative tract map for 43 lots, one of which permits 4 residential units, and the following conditions: rnn11 itinnc! 1. Applicant shall file a precise development plan for city approval within thirty (30) months, Preliminary development plan approval shall expire in 30'months if precise development plan is not filed and approved. 2. Applicant shall obtain approval of the project from city Architectural Review Commission. Said plans shall include a housing unit placement scheme that will avoid dominance or repetition of unit types and setbacks, and shall provide detailed plans for landscaping, fencing and signing 3. Applicant shall dedicate and improve 1.5 acre park with grass ground cover and automatic sprinkler system,, Applicant shall perform minor, grading in front area of the park.to ensure drainage to the adjacent street. 4.. Minimum street yard setbacks:for all houses and garages not facing the street shall be 10 feet. Setback for garages facing the street shall be 20 feet. 5. Condominium unit closest to Broad Street shall have provisions for noise attenuation to limit noise to 45 db. on the interior of said building.. Outdoor patio areas for condominium units shall be provided with landscape berming, walls or fences to ensure a maximum outdoor noise level of 60 db., consistent with the Noise Element of the adopted city general plan. 6. Only proposed house plans A -E shall be constructed on lots which back up to the north project boundary.. SECTION 3. This ordinance, together with the ayes and noes,,shall,.be` published once in full, at least three (3) days prior to its final passage, Ordinance No. 933 (1982 Series) Page 3 in the Telegram - Tribune, a newspaper published and circulated in said city, and the same shall go into effect at the expiration of thirty (30) days after its said final passage.
