HomeMy WebLinkAbout0095ORDINANCE NO. 95 (1958 Series) AN ORDINANCE ADOPTING THE UNIFORM BUILDING CODER 1958 EDITION, VOLUME.I. BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. That Sections 8100.2, 8100.5, 810007, 8100.9, 8120, 8120.1 and 8120..2 of. the San Luis Obispo Municipal Code are hereby repealed. SECTION 2. That Section 8100.3-is hereby amended to read as follows: Section 810001 Uniform Buis Code Adopted. That a certain document, three copies of which are on file in the office of the City Clerk, being.marked and designated as "Uniform Building Code, 1958 Edition, Volume Is" and which copies may be identified by the Seal of the City of San Luis Obispo appearing thereon, bee and the same is hereby adopted as the building code of the City for.reguleting the erection, construction, enlargement, alteration, repair, moving, removal, demolition, conversion, occupancy, equipment, use, height, area and maintenance of all buildings and structures in.the Citys providing for issuance of building permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of the "Uniform Building�'Code, 1958 Editions Volume I" including appendix contained therein'are hereby referred to, adopted and made a part hereof as if fully set out in this Chapter; except such provisions as are modified by the provisions of this Chapter. SECTION 2. That Section 8100.2 shall read as follows: Section 8100.2 Amendments. The following sections of the Uniform Building Code, 1958 Edition, Volume I, are hereby amended'to read as follows: 301 (b) Applications To obtain a;.pQrin .t the applicant shall first file an application therefor in writing` .on a form furnished for that purpose. Every such application shall,:.° 1. Identify and describe the work to be covered by the permit for which application,is made; 2. Describe the land on which the proposed work is to be done, by lot, blocks tracts,and house and street address, or similar description that; vill readi ly identify and definitely locate the proposed buil�)in or, work; 3. Show the use or occupancy of all parts of the building; 4. Be accompanied by plans and specifications as required in subsection (c) of this Section; 5. State the valuationi"of the proposed work; b. Be signed by the permittee, or his authorized agent, who may be required to submit,evidencb to'indicate such authority; 7. Give such other information.as.reasonably may be required by the building official ;' 8. State whether structure is to be sold or is for applicant's personal use; 9. If hiring help, if applicant is aware of the state compensation and unemployment requirements; 10. State garage floor and street Oewations. 301 (c ) Plans and Specifications; G'ith each application for; a building permit for any new construction or any work involving structural change or addition to an existing structure, � , or when required by the building official for enforcement of any provision of this Code, three sets of plans and specifications shall be submittedo The building official may require plans and specifications to be prepared and designed by an en'g - cheer or architect licensed by the :state to practice as such, Exceptions: When authorized by the •buildin fr official, plans and specifications need not be submitted for the following: 1. One -story buildings of Type V conventional wood -stud construction with an area not exceeding 600 square feet; 2. Group J, Division 1, occupancies of Type V conventional wood -stud construction; 3. Small and unimportant work. 302 (d) Expiration. Every permit issued by the building official under the provisions of this Code shall expire,by limitation and become null and void, if the building or work authorized by such permit is not commenced within 60 days from the date of such,permit, or if the building or work authorized by such permit is suspended or 'abandoned at any time After the work is commenced for a period of-120-days. Provided further, that every permit shall automatically expire 18 months after the date of issuance. before. such work can be recommenced.a new permit shall be first obtained so to do, and the fee therefor shall be one -half the amount required for a new permit for such work, provided no changes have been made or will be made in the original plans and specifications for such work; and provided, further, that such.,suspension or abandonment has not exceeded one year. Section' c) is'.hereby added to read: 303 (c) Schedule of, Investigation of Fees. then work for which a:pe.rmit,is required under this Code is begun or carried on without a p6kTdt, then no permit shall be issued in such cases without a spacial investigation and.the payment of a special investigation fee in addition to the double';fee set forth in Section 303 (a) to be determined by the following schedule. X10.00 or less,;... 1,10,00 over. a X10.00 to ;i•15.00... 41.15000 over . 415,00 to 420.00... 420.00 over. . iv20.00 or more..... 425.00 Payment of these fees shall not relieve any person from fully complying with the requirements of'this Code nor from any penalty prescribed by law. 1302 (b) Special Provisions, Group H occupancies more than two stories in height or having more than three thousand sGuats.feet ;(,x,000,sq.ft.) of floor area above the first floor shall be of "n less than one -hour fire- resistive construction throughout. Group H occupancies normally requirinf- fire - retardant roof coverings may be permitted.to.have hand -split shakes, provided a solid sheathing of gypsum Wallboard not less than one -half inch thick is first applied over required wood sheathing or -other material of equivalent fire retardant value. For attic space and draft stops see Section 3205. Section 1602 '(b) "shall be amended by adding the following paragraph at the end of said sections 2. 6. Vo building already erected in Fire Zone I shall hereafter be altered, raised, enlarged, added to, or moved in Fire Zone I unless the altered or added portions be constructed and fire protected in accordance -with•.requirements for new construction in Fire Zone I. .`section 1603 (b) shall be amended by adding the following paragraph at the end of said sectioni No building already erected in Fire Zone Ii shall hereafter be altered, raised, enlarged,:added to or.,moved in Fire Zone II unless the altered or added portions be constructed and fire protected in accordance-with requirements for new construction in Fire Zone II. Section 2606 shall be amended by adding ,the following paragraph at the t• end of said section: 111inimum concrete shall test at least 2,000 pounds per square inch, Section 5102 (c-2) shall be amended by adding the fonowinr, paragraph at the end of said section: If such openings or ducts convey air from an attic space, the attic space shall be ventilated by fresh air openings or louvres on a vertical wall or at two different levels or elevations, and such openings shall be provided on the upper side with a hinged wooden cover one inch in thickness held in the open position by a fusible link device approved by'the Chief of the City Fire Department, 5107 (b) 1-4ter Heaters Installed in Garda ess. Gas water heaters installed in garages shall be adequately guarded against mechanical injury and.from coming in contact with combustible material and shall be•located at least 24 inches above floor level. SECTION 3. This ordinance, together with the ayes and noes, shall be published once in full, at least three days before its final passage, in the Telegram - Tribune, a newspaper published and circulated in'said city, and the same shall go into effect at the expiration of thirty days after its final passage. Said public hearing will be held on Monday, September 21, 1964 at 9:00 P.M. in the Council Chambers of the City Hall, 990 Palm Street, San Luis Obispo, California. J. H. FITZPATRICK City Clerk September 3 , 1 ")64 Chapter 2 - PLUMBING SECTION 8200. Uniform Plumbing Code. Adopted. The Uniform Plumbing Code, 1964 Edition, and appendices, three copies of which are on file with the City Clerk and may be identified by the seal of the City appearing thereon, is hereby adopted by reference as the Plumbing Code of the City, except as amended by the provisions of this chapter. SECTION 8200.1. Amendments. The following sections of the Uniform Plumbing Code are amended as follows: Section 1.1 Insert "Building Official" in the space provided. Section 1.2 Insert "Building Inspector" in the space provided. Section 1.3 Insert "Planning and Building" in the space provided. Section 1.7 Insert.% "three- hundred dollars ($300) ", "City or County" and "three (3)" in the appropriate spaces provided. Section 1.10 Add Section 1.10(d) as follows: A permit may be issued to an owner to replace a water heater in his dwelling or apartment if such replacement does not require any changes or additions to the gas or water piping systems. Section 1.12. Add the following: If work for which a permit is required under this Code is begun without a permit the work shall stop upon notification by the Building Department. No permit shall be issued in such cases without a special investigation and the payment of a special fee, in addition to the double fee set forth in this section above, to be determined by the following schedule: J v \ ARTICLE VIII - BUILDING REGULATIONS Chapter 1 - BUILDING CODE UKAr i August 31, 1964 SECTION 8100. Uniform Building Code. Adopted. The 'Uniform Building Code, 1964 Edition, Volume I and appendices, 3i� copies of,which are on file and may be identified by the seal of the City appearing thereon with the City Clerk, is hereby adopted by reference as the Building Code of the City, except as amended by the provisions of this Chapter. SECTION 8100.1. Building Official. The Director of Planning and Building is hereby designated the Building .Official. SECTION 8100.2. Civil Defense Shelters Exempt from Building Code. 1. Any structure which is designed exclusively as a Civil Defense shelter is exempt from the Building Code. SECTION 8100.3. Amendments �The following sections of the Uniform Building Code, 1964 Edition, Volume I are hereby amended as follows: Section 301. Add subsection 301(b)8 as follows: Show garage floor elevation and street elevation opposite driveway. Add the following to subsection 301(c): Three sets of plans shall be submitted. Section 302. Add the following to subsection 302(d): Every permit shall. autorfirt -. tically expire eighteen (18) months after date of issue. Section 303. Add the following to Section 303(a) : In addition to the < (oib.le fee required by this section, a special investigation fee shall he paid as follows: Chapter 2 - PLUMBING -2- September 3, 1964 Normal fee Special Fee $10.00 or less ------- --- ------- ------ $10.00 over $10.00 to $15.00 ----- ---------------- $15.00 over $15.00 to $20.00 ------ --- ---- -------- $20.00 $20.00 or more ------ ----------------- $25.00 Payment of these fees shall not relieve any person from fully complying with the requirements of the Plumbing Code nor from any penalty set forth in Section 1.7. No permit shall be issued unless all fees due are paid. Section 2.5(b). Delete. Section 2.9(b) Insert "June 30th" in the space provided. f Section 2.10 Insert "one dollar ($1.00)" and "two dollars ($2.00)" in the appropriate spaces provided. Section 711 Add 711(o) as follows: No pot sink or other fixture shall discharge into the same grease interceptor serving a dishwashing machine. Section 910 Change section 910 to: Each building shall be provided with sanitary facilities as listed in appendix "C" of this Code. Approved toilet facilities for workmen shall be provided and maintained in a sanitary condition on the job site, during the construction of buildings. Section 1103 Add 1103(c) as follows: No Bituminous fiber pipe shall be used as a building sewer. Add section 1711(f) as follows:. Section 909 of the Uniform Plumbing Code regulating shower stalls shall apply. Section 2517. Add the following to Section 2517(c): In concrete formwork, 3/4" diameter round metal stakes only, shall be permitted within required footings. Section 2806. Add this footnote to Table 28 -0 Not less than one continuous steel re- inforcing bar, of at least one -half inch Q ") in diameter shall be placed in all footings, and another 3 to 6 inches from the top of all foundation walls except those footings resting directly on solid rock. Such bars shall be installed in an approved manner. Section 3203(d)8. Change the first paragraph of section 3203(d)8 as follows: Shakes shall be applied to roofs with solid or spaced sheathing. Spaced sheathing shall be not less than one inch by four inches nominal size and shall be spaced not to exceed seven and one -half. inches (71 ") center to center for eighteen inch (18 ") shakes; ten inches (10 ") center, to center for twenty -four inch (24 "); and thirteen inches (13 ") center to center for thirty -two inch (32 ") shakes. Section 3305(n). Section 3305(n) shall be chat ed as follows: Every required stairway, including landing, shall have unimpaired headroom of not less than six feet six inches (616 ") for its entire length. Headroom shall mean the ` '"'`vertical distance fi a continuous straight liq? drawn above, tangent to the stair nosings and one foot past top and bottom nosings and a line ,71?(-)vc: ai,(i parallel to such line:. Section 3305(o). Where stairs are provided to the roof of a building or structure they shall be so constructed as to deny public access to the roof. Exception - The public need not be denied access to such roof provided it complies with section 2305(e) and section 3302(a) and the area to which the public is admitted is enclosed with an unclimbable wall not less than four feet six inches (41611) high. Doors and gates to such en- closure shall be self- closing and self - latching with the latching hard- ware located not less than four feet six inches (4'611) above the floor. Section 5101(b). Add the definition of Central Heating Plant or Heating Plant - Comfort heating equipment installed in a manner to supply heat by means of ducts or pipes to areas other than the room in which the equipment is located. Section 7001. Add the following to Section 7001: The City Engineer shall enforce this chapter. Where "Building Official" appears in this chapter "City .Engineer" shall apply. Section 7007. Add subsection 7007(g) as follows: All grading in residential zones or within one thousand feet (1000') of any residential occupancy, hotel, motel, or hospital shall be done between the hours of 7 :OOA.M. and 7:00 P.M. except in an emergency. All graded surfaces and materials shall be wetted, protected or contained in such manner as to prevent dust or spill upon any adjoining property or street. Section 7012. Change section 7012(c) to the following: The maximum slope of any fill shall not exceed two (2) horizontal to one (1) vertical.
