AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO AMENDING CERTAIN
SECTIONS AND SUBSECTIONS OF ARTICLE VIII, CHAPTER 8 OF THE
SAN LUIS OBISPO MUNICIPAL CODE, ENTITLED "HOUSE MOVING AND
DEMOLITION ORDINANCE"
BE IT ORDAINED by the Council of the City of San Luis Obispo as follows:
SECTION 1. Section 8800.8, Subsection "A ", is amended to read: "For
matters concerning, site location and aesthetics, the provisions of Section
9204.8 of the Municipal Zoning Regulations shall apply."
Section 8800.9, Subsection "H" is amended to read: "Water for dust..
control may be obtained from a City source provided arrangements are made in
advance with the City Water Billing Office."
Section 8800.14 is amended to delete the second paragraph and add the
following exception: "EXCEPTION: One story, wood frame buildings, may be
demolished by the owner thereof, providing the distance from the public side-
walk or right -of -way to the building is equal to 1/2 the height of the build-
ing measured to the highest point on the roof, or 10 feet, whichever is greater."
Section 8810.1, Subsection "C -2 ", second paragraph, is amended to read:
"Within 10 days of the ARC determination that an application to demolish in-
volves a significant structure, the City Clerk shall place an advertisement
in a newspaper of general circulation in the city, announcing the proposed
demolition. The ad shall show the location of the structure on a vicinity map
with the street address. The City Clerk shall also, within the aforementioned
ten (10) days, notify by first -class mail, any persons or organizations that
have asked to be notified of applications for demolition permits."
Section 8810.3, Subsection "E ", is amended to read:
"All foundations, concrete slabs and /or building substructures shall be removed
to at least thirty (30) inches below grade."
Section 8810.3, Subsection "E ", is amended to add the following 2 ex-
ceptions:
"EXCEPTION: 1. Foundations, concrete slabs on grade and building sub-
structures may remain provided all of the following conditions are met:
a. A tentative redevelopment plan for the property is submitted and filed
with the Community Development Department.
b. Redevelopment of the property shall occur within two years from the
date the demolition permit is issued. A one -year extension may be granted

by the Community Development Director. No additional extensions will be
granted. Requests for extensions shall be made 30 days prior to expiration.
c. The property shall be maintained clean of weeds and debris at all
times, and shall be screened to the satisfaction of the building official.
d. The owner(s) shall file, with the city, a written guarantee, and
a performance bond in the amount of $5,000.00 to assure the removal of the
foundation(s), slab(s) and /or substructure(s). The bond shall be for the
two year period and shall be extended when an extension of time is granted.
e. The property shall be fenced when the Building Official determines
a hazard would be caused by allowing the foundation, slab or substructure
to remain.
EXCEPTION: 2. Foundations, concrete slabs on grade and building
substructure may remain when the removal thereof may endanger the structural
integrity of adjoining buildings. The use of this exception requires the
erection of a solid six foot high fence, as a visual barrier.
F. For the purposes of this subsection, certain words and their
derivatives may be defined as follows:
a. Foundations; the structure, usually of concrete, resting on or in
the ground, including the footing, on which a building is erected.
b. Foundation wall; the walls of concrete or masonry which support a
building.
C. Footing; a projecting course of concrete placed under a foundation
wall to distribute and transmit loads directly to the soil or the piles.
d. Slab; a flat piece of material, usually of concrete, placed on the
ground for use as a building floor, patio, driveway, walk, ball court and /or
similar uses.
e. Sub - structure; the foundation of a building or structure including
the piers and piles.
Section 8810.5 is amended to read:
"Upon completion of the removal of the building, structure or utility, by
either demolition or moving, the ground shall be left in a clean, smooth
condition. Holes in the ground, basements or cellars, shall be filled with
inorganic material; provided, however, the top one foot of fill shall be

clean earth. The filling of such excavation may not be required when a
building permit has been issued for a new building on the site and the
construction thereof is to start within 60 days after the completion of
demolition or moving operations. The holder of the building permit shall
provide a temporary barricade protecting the excavation on all sides as
specified by the Building Official. Temporary barricades may remain in
position for a time not exceeding five (5) days, after which a solid barri-
cade shall be provided or the excavation filled. Barricades shall be not
less than forty -two inches (42 ") high Detailed plans for barricades shall
be submitted for review and approval."
SECTION 2. This Ordinance, together with the ayes and noes, shall be
published once in full, at least three days before its final passage, in the
Telegram- Tribune, a newspaper published and circulated in said City, and the
same shall go into effect at the expiration of thirty (30) days after its
said final passage.

19th day of April 1983, on motion of Councilman Settle seconded
by Mayor Billig , and on the following roll call vote:
