AN ORDINANCE OF THE CITY OF SAN LUIS OBSIPO APPROVING
AN AMENDMENT TO THE CONTRACT BETWEEN THE BOARD OF
ADMINISTRATION PUBLIC EMPLOYEES' RETIREMENT SYSTEM
AND THE CITY COUNCIL OF THE CITY OF SAN LUIS OBISPO
BE IT ORDAINED by the Council of the City of San Luis Obispo as follows:
Section 1. That an amendment to the Contract between the City Council
of the City of San Luis Obispo and the Board of Administration, California
Public Employees' Retirement System is hereby authorized, a copy of said
amendment being attached hereto, marked "Exhibit A ", and by such reference
made a part hereof as.though herein set out in full.
Section 2. The Mayor of the City of San Luis Obispo is hereby author-
ized, empowered, and directed to execute said amendment for and on behalf of
said Agency.
Section 3. A summary of this Ordinance, approved by the City Attorney,
together with the ayes and noes, shall be published at least three (3) days
prior to its final passage in the Telegram- Tribune, a newspaper published and
circulated in said City, and the same shall go into effect at the expiration of
thirty (30) days after its said final passage. A copy of the full text of this
ordinance shall be on file in the Office of the City Clerk on and after the
date following introduction and passage to print and shall be available to any
interested member of the public.
INTRODUCED AND PASSED TO PRINT by the Council of the City of San Luis
Obispo at a meeting held on the 3rd. day of May , 1983, on motion of
Councilman Settle , seconded by Councilman Dunin , and on the following
roll call vote:

AMENDMENT TO CONTRACT BETWEEN THE
BOARD OF ADMIFTSTRATION
PUBLIC EMPLOYEES' RETIREIwiENT SYSTEM
AND THE
CITY COUNCIL
OF THE
CITY OF SAN LUIS OBISPO
The Board of Administration, Public Employees' Retirement System, herein -
after referred to as Board, and the governing body of above public agency, here-
inafter referred -to as Public Agency, having entered into a contract effective
July 1, 1952, and witnessed June 9, 1952, and as amended effective July 1,
1952, October 1, 1362, October 3, 1963, October 1, 1974, June 1, 1976, December
1, 1976, December 20, 1978, January 16, 1980, May 1, 1980 and July 1, 1980,
which provides for participation of Public !Agency in said System, Board and
Public Agency hereby agree as follows:
A. Paragraphs 1 through 10 are hereby stricken from said contract as executed
effective July 1, 1980, and hereby replaced by the following paragraphs
numbered 1 through 10 inclusive:
1. All words and terms used herein which are defined in the Public Employ-
ees' Retirement Law shall have the meaning as defined therein unless
otherwise specifically provided. "Normal retirement age" shall mean
age 60 for local miscellaneous and age 55 for local safety members.
2. Public Agency shall participate in the Public. Employees' Retirement
System from and after July 1, 1952 making its employees as hereinafter
provided, members of said System subject to all provisions of the
Public Employees' Retirement Law except such as apply only on election
of a contracting agency and are not provided for herein and to all
amendments to sa.id Law hQreafter enacted except such as by express
provisions thereof apply only on the election of contracting agencies.
?. Employees of Public Agency in the following classes shall become mem-
bers of said Retirement Systera except such in each such class as are
excluded by law or this agreement:
a. Local Firemen (herein referred to as local s,,afety members);
b. Local Policemen (herein referred to as local safety members);
C. 'rmployees other than local safety members (herein referred to as
local miscellaneous members).
Tri addition to the classes of employees excluded from membership by
said Retirement Law, the following classes of employees shall not
become members of said Retirement System:
CROSSING GUARDS
4. The fraction of final compensation to be provided for each year of cre-
dited prior and current service as a local- miscellaneous member shall
be determined in accordance with Section 21251.13 of said Retirement
I„aw (2,% at age. 60 Full) .
5. The fraction of final compensation to be provided for each year of cra --
dited prior and current service as a local safety member shall be do--
termined in accordance with Section 21252.6 of said Retirement Law (2'
at age 55 Full).
a. Paragraph 5 shall not apply to those local safety members who
elect to continue under the provisions of Section 21252.1 within
90 days of this amendment to contract.
6. The following additional provisions of the Public Employees' Retire-
ment Lew which apply only upon election of a contracting agency shall
apply to the Public Agency and its employees:
a. Oections 21,..80 -21767 (1959 Survivors Program) excluding Section
21:82.2 (increased 1959 Survivors benefits).
b. Sections 212.63!21263.1 (Post - retirement survivor allowance) for
local safety members only.
C. Section 20862.8 (Unused sick leave credit).
d. Section 20?52.5 (Age SO voluntary retirement) for local safety
members only.
e. Section 20024.2 (One -year final compensation).
7. Public Agency, in accordance with Section 20"40, Government Code, ceas-
;e,l to be -,in "employer" for purposes of Chapter 6 of the Public Employ-
ees' Retirement Lnw effective on June 1, 1976. Accumulated contribu-
tions of Public Agency as of the aforementioned date shall. be fixed
=:.nd determined as provided in Section 2 0' 759, Government Code, -end ac-
cumulated contributions as of the aforementioned date and contribu-
tions thereafter made: shall be held by the Board as provided in Sec-
tion 20'59 . Government Code.
o. Public Agency Chalj. contribute to said Retirement System as follows:
With respect to miscellaneous members, thc: :agency sh, ^11 contri-
buto the following percentages of monthly salaries earned as mis-

(1) 11.057 percent until June '0, 2000 on account of the
liability for current servic(: ben( ,-fits.

Survivor Program.
b. With i tpect to local safety members, ti,e agency shall contribute
the following percentages of monthly salaries earned as local
safety members of said. Retirement System:
I j 21 .203 percent until June `;U, 2000 on account of the
liability for current service benefits.
C. A reasonable amount, as fixed by the Board, payable in one instal-
lment within 60 days of date of contract to cover the costs of ad-
ministering said System as it affects the employees of Public Ag-
ency, not including the costs of special valuations or of the per-
iodic investigation and valuations required by law.
d. A reasonable amount as fixed by the Board, payable in one instal-
lment as the occasions arise, to cover the costs of special valua-
tions on account of employees of Public Agency, and costs of the
periodic investigation tind valuations required by law.
9. Contrilutions required of Public Agency and its employees shall be sub-
ject to adjustment, by Board on account of amendments to the Public Em-
ployees' Retirement Law, and on account of the experience under the Re-
tirement System as determined by the periodic investigation and valua-
tion required by said Retirement Law.
10. Contributions required of Public Agency and its employees shall be
paid by Public Agency to the Retirement System within thirty days af-
ter the end of the period to which said contributions refer or as may
be prescribed by Board regulation. If more or less than the correct
amount of contributions is paid for any period, proper adjustment
shall be made in connection with subsequent remittances, or adjust -
mants on account, of errors in contributions required of any employee
may be made by direct cash payments between the omployee and the
Board. Payments by Public Agency to Board may be made in the form of
warrants, bank checks, bunk drafts, certified checks, money orders or
cash.
