This structure needs to be re- designed to fit the site. Recommend smaller house and lower level outdoor space. The roof top deck should NOT be approved. THERE IS NO PRECIDENT AND ONE SHOULD NOT BE SET. It is not compatible with neighborhood standards. FACT: Sound /noise from the out of doors at rooftop can be amplified. DO THE PLANNERS NOT KNOW THAT SOUND CARRIES UPWARD ? Point: The Upper Bishop's Peak area is greatly impacted by outdoor sound from Cal Poly and much more so than we are on the lower streets. The Secondary Dwelling Unit should not be approved. At the first hearing (Planning Commission) it was very interesting to seee the 'waffle' between City Planner presenting the possibility of the unit and the applicant acting like he didn't want it (Planner then looking confused) Perhaps the owner learned the "Owner Occupancy" necessary for its use. My personal analysis was that something was being manipulated. No, I cannot read minds. I have, however, seen developers try to pull the wool, so to speak. The public is so tired of manuvering allowed and even sometimes supported by staff. The owner should be asked to return with having removed the objectionable elements from his plan. The Planning Commission saw the egregious elements. Did they do anything wrong legally? They are only an advisory committee doing a public service. We see the owner wanted to present a letter from a lawyer. Really? He had the right to appeal to Council anyway. You have the right to see that his plan suit neighborhood safety and compatibility standards. Yes, we are a city who cares about its neighbors. I believe this makes us special. Thank you for seeing the important aspects that must be adhered to by those choosing to build in San Luis Obispo. Respectfully, Camille Small FYI: The letter from the 1980's in the record for this property states very plainly THIS LOT IS VERY VISIBLE FROM HWY 101.
