If the City had taken timely action, a City - County -Private partnership could have constructed a parking structure on this large property by now with street - fronting retail. The Fremont Theater and Mission Cinemas may not have declined in usage as greatly, and a mixed use neighborhood would be developing. This item's proposed agreement and project should not alter the Concept Plan vision for a large garage to serve the County, the theaters and businesses on Monterey Street and in the emerging mixed use neighborhood on Upper Monterey Street. Please keep in mind that the proposed "gift" of a parking garage with this project should involve the County of San Luis Obispo, since the project could easily absorb the existing County parking lot on Monterey Street, behind the previous Shell station. If the County agreed to allocate its parking spaces to the proposed garage, this property could be used by the developer for enough floor area to reduce the proposed building heights significantly, perhaps to within the existing 45 -foot height limit. Lastly, we all understand that the agreement does not embody any obligation or interest in the City supporting the developer's proposal to override the City's Downtown Concept Plan and existing C-R zone with a spot zoning through the proposed Planned Development project.
