Two Resolutions regarding the Assessment District at Madonna
Road
CAO RECOMMENDATION:
! 1. Resolution amending Resolution 5815 - Preliminary Determination
for Madonna Road Assessment District;
2. Resolution giving Preliminary Approval to Engineer's Report and
setting public hearing for July 1, 1986.
BACKGROUND
1. On October 15, 1985, the Council adopted Resolution 5815
concerning preliminary determination and intentions regarding the
Assessment District.at Madonna Road. The proposed resolution
amends the maximum term of years of the bonds to 30 years.
Certain unique features of the current bond market not foreseen
in October, make this term attractive and cost-effective for the
City.
2. On October 15, 1985, the Council also adopted Resolution 5814
appointing Wayne Peterson the Engineer for the Assessment
District. The proposed resolution gives preliminary approval to
the Engineer's Report and sets July 1, 1986 as the public hearing
for final approval of the: Assessment District. The completed
Boundary Map and Assessment Diagram will be on file with the City
Clerk on May 20, 1986.
By adopting both resolutions,' the Council is not,committing itself to
complete the financing. Rather`, it is taking the next statutorily
mandated step to having the public hearing.
As the Council will recall, the Assessment District financing is one
of three programs for financing road improvement in and around the
new San Luis Mall -- IDB's were issued in December, this Assessment
District and the Asset .Transfer are both going forward at this time
with July, 1986 as the planned date of issuance.
RECOMMENDATION:
I. Adopt Resolution amending Resolution 5815 - Preliminary
Determination for Madonna Road Assessment District
2. Adopt Resolution giving Preliminary Approval to Engineer's Report
and setting public hearing for July 1, 1986.

A RESOLUTION OF TIE COUNCIL OF TIE CITY OF SAN LUIS
OBISPO OF PRELIMINARY -DETERMINATION AND OF
INTENTION TO MAKE ACQUISITIONS AND IMPROVEMENTS
FOR MADONNA ROAD ASSESS= DISTRICT
BE IT RESOLVED by the Council of the City of San Luis Obispo as
follows:
That the City Council does hereby preliminarily determine that the
public interest, convenience and necessity require, and that it intends to
order The making of the acquisitions and improvements described in Exhibit
"A" attached hereto and made a part hereof.
1. Except as herein otherwise.provided for the issuance of bonds, all
of said work shall be done as provided in the Municipal Improvement Act of
1913 and Section 19 of Article XVI of the Constitution of the State of
California.
2. All of said work and improvements are to be constructed at the
places and in the particular locations, of the forms, sizes, dimensions
and materials, -and at the lines, grades and elevations, as shown and
delineated upon the plans, profiles and specifications to be made
therefor, as hereinafter provided. there is to be excepted from the work
above described any of such work already done to line and grade and marked
excepted or shown not to be done on said plans, profiles and
specifications. Whenever any public way is herein referred to as running
between two public ways, or from or to any public way, the intersections
of the public ways referred to are included to the extent that work is
shown on said plans to be done therein. Said streets and highways are or
will be more particularly shown in the records in the office of the County
Recorder of San Luis Obispo, State of California, and shall be shown upon
said plans.

3. Notice is hereby given of the fact that in many cases said work
and improvements will bring the finished work to a grade different from
that formerly existing, and that to said extent said grades are hereby
changed and that said work will be.done to said changed grades.
4. In cases where there is any disparity in level or size between the
improvements proposed to be made herein and private property and where it
is more economical to eliminate such disparity by work on said private
property than by adjustment of the work on public property, it is hereby
determined that it is in the public interest and more economical to do
such work on private property to eliminate such disparity. In such cases,
said work on private property shall, with the written consent of the owner
of said property, be done and the actual cost thereof may be added to the
proposed assessment of the lot on which said work is to be done.

5. This Cduncil.does hereby adopt and establish as the official
grades for said work the grades and elevations to be shown upon said
plans, profiles and specifications. All such grades and elevations are to
be in feet and decimals thereof with reference to the datum plane of this
city.
6. The descriptions of the acquisitions and improvements and the
termini of the work contained in this Resolution are general in nature.
A11 items of work do not necessarily extend"for the full length of the
description thereof. The plans and profiles of the work and maps and
descriptions as contained in the Engineer's Report, hereinafter directed
to be made and filed, shall be controlling as to the correct and detailed '
description thereof.

7. Said contemplated acquisitions and improvements, in the opinion of
this Council, are of more than local or ordinary public benefit, and the
costs and expenses thereof are made chargeable upon an assessment
district, the exterior boundaries of which are shown on a map thereof on
file in the office the City Clerk, to which reference is hereby made for
further particulars. Said map indicates by a boundary line the extent of
the territory included in the proposed district and shall govern for all
details as to the extent of the assessment district.
S. This Council declares that all public streets, highways, lanes and
alleys within said assessment district in use in the performance of a
public function, and all lands owned by any public entity, including the
United States and the State of California, or any.departments thereof,
shall be omitted from the assessment hereafter to be made to cover the
costs and expenses of said acquisitions and,im}provements.
9. Said acquisitions and improvements are hereby referred to Wayne
Peterson, City Engineer of this City, as Engineer of Work.fgr this
assessment district, employed by this City for the purpose hereof, and
said Engineer of Work is hereby directed to make and file with said Clerk
a report in writing, presenting the following:
(a) Maps and descriptions of the lands and easements to be acquired,
if any;
(b) Plans and specifications of the proposed improvement if the
improvement is not already installed: The plans and
specifications do not need to be detailed and are sufficient if,
they show or describe the general nature, location, and extent of
the improvements. If the assessment district is divided into

zones, the plans and specifications shall indicate the class and
the type of improvements to.be provided for each zone. The.plans
or specifications may prepared as separate documents, or
either or both may be incorporated in the report as a combined
document.
(c) A general description of works or appliances already installed
and any other property necessary or convenient for the operation
of the improvement, if the works, appliances, or property are to
be acquired as part of the improvement.
(d) An estimate of the cost of the improvement and of the cost of
land, rights -of= -way, easements, and incidental expenses in
connection with the improvement, including any cost.of
registering bonds..
(e) A diagram showing, as they existed at the time of the passage of
the
resolution of
intention,
all of the following:
1.
The exterior
boundaries
of the assessment district.
2. The boundaries of any zones within the district.
3. The lines and dimensions of each parcel of land within the
district.
Each subdivision, shall be given a separate number upon the
diagram. The diagram may refer to the county assessor's maps for
a detailed description of the lines and dimensions of any
parcels, in which case those maps shall govern for all details
'concerning the lines and dimensions of the parcels.
(f) A proposed assessment of the total amount of the cost and
expenses of the proposed improvement upon the several.

subdivisions of land in'the district in proportion to the
estimated benefits to be received by each subdivision,
respectively, from the improvement:
When any portion or percentage of the costs and expenses of said
acquisitions and improvements is to be paid from sources other than
assessments, the amount of such portion or percentage shall first be
deducted from the total estimated cost and expenses of said acquisitions
and improvements, and said assessment shall include only the remainder of
the estimated cost and expenses.
10. If any excess shall be realized from the assessment it shall be
used,. in such amounts as this Council may determine, in accordance with
the provisions of law, for one or more of the following purposes:
(a) Transfer to the general fund of this City, provided that the.
amount of any such transfer shall riot exceed the lesser of $1,000 or 5% of
the total amount expended from the improvement fund;
(b). As a credit upon the assessment and any supplemental
assessment; or
(c) For the maintenance of the improvements.
11. Wayne Peterson, City Engineer of the City of San. Luis Obispo, is
hereby designated as the person to answer inquiries regarding any protest
proceedings to be had herein, and may be contacted during regular office
hours'at City Hall, 990 Palm Street, San Luis Obisr)o, California 93401, or
by calling (805) 549-7100.
12. To the extent that any of the work, rights, improvements and
acquisitions indicated in the Engineer's Report, to be made as provided
herein, are shown to be connected to the facilities, works or.systems of,

or are w be own -led, managed and controlled W. , any public agency other
than this City, or of any public utility, it is the intention of this
Council to enter into an agreement with such public agency or public
utility pursuant to Chapter 2 (commencing with Section 10100) of Division
12 of the Streets and Highways Code, which agreement may provide for,
among other matters, the ownership, operation and maintenance of such
agency or.utility of said works, rights, improvements and acquisitions,
and may provide for the installation of all or a portion of such
improvementsby said agency or utility and for the providing of service to
the properties in the area benefiting from said work, rights, improvements
and acquisitions by such agency or utility in accordance with its rates,
rules and regulations, and that such agreement shall become effective
after proceedings have been taken for the levy of the assessments and sale
of bonds and funds are available to carry out the terms of any such
agreement.
13. Notice is hereby given that serial bonds to represent unpaid
assessments, and bear interest at the rate of not to -exceed twelve percent
(12%) per annum, or such higher rate of interest as may be authorized by
applicable law at the time of sale of such bonds, will be issued hereunder
in the manner provided by the Improvement Bond Act of 1915, Division 10 of
the Streets and Highways Code, the last installment of which bonds shall
mature not to exceed nineteen (19) years from the second day of September
next succeeding twelve (12) months from their date.
14. The provisions of Part 11.1 of Division 10 of the Streets acid
Highways Code, providing for an alternative procedure for the advance
payment of assessments and the calling of bonds, shall apply to bonds
issued pursuant to Paragraph 13 above.
15. Notice is hereby given that it is the intention of this Council
to consider adoption of an ordinance, pursuant to Section 10205 of the
Streets and Highways Code, authorizing contributions by the City of San
Luis Obispo, from any sources of revenue not otherwise prohibited by law,
Of a specified amount, portion or percentage of such revenues, for the
purpose of acquisition or construction of improvements, the acquisition of
interests in real property and the payment of e�cpenses incidental thereto
for the use and benefit of the assessment district contemplated by this
Resolution, and to consider authorizing application of such revenues as a
credit upon the assessment to be levied in proceedings pursuant hereto.
16. It is the intention of this Council to create a special reserve
fund pursuant to and as authorized by Part 16 of Division 10 of the.
Streets and Highways Code of the State of California.

WORK DESCRIPTION
MADONNA ROAD ASSESSMENT DISTRICT
Within the City of San Luis Obispo, County of San Luis Obispo, the
following improvements shall be constructed according to plans and
specifications to be approved by the City of San Luis Obispo, the
California Department of Transportation and such regulated public
utilities as may own, operate and maintain said improvements upon their
respective comuletions:
1. The widening and improvement of Madonna Road including all
required removal of existing pavement, grading, pavement, curbs,'
gutters, sidewalks, median islands, conforming changes at the
intersection of Madonna Road and Zozobra Road, street lights, traffic
signals and controls, street signs and striping and the installation of
required storm drainage, water, sewer and gas and electric utility
facilities;
2. A public parking lot bounded by Highway 101, Madonna Road,
Zozobra Road and E1 Mercado Road including approximately 1300 parking
spaces, clearing, grading, paving, striping, signs, and.lighting as
required;
3. Landscaping as required to be installed in conjunction with
items 1 and 2 above, including shrubs, ground cover, trees, required
irrigation and lighting and control systems and decorative features;
4. Improvements to portion of the freeway interchange at Madonna
Road and Highway 101 including off and on ramps, clearing, pavement,
signs, striping and conforming changes as required; and
5. The acquisition of all rights-of-vaay, easements, licenses,
franchises, and permits and the performance of all auxiliary work
necessary and/or convenient for the accomplishment of the foregoing
improvements.

A RESOLUTION PRELIMINARILY APPROVING ENGINEER'S REPORT,
APPOINTING TIME AND PLACE OF'HEARING PROTESTS
AND DIRECTING ACTIONS WITH RESPECT THERETO

Madonna Road Assessment District
RESOLVED, by the City Council of the City of San Luis Obispo, San Luis
Obispo, California, that
WHEREAS, on October 15, 1985 this Council adopted Resolution No. 5815
(1985 .Series), a Resolution of Preliminary Determination and of Intention to
Make Acquisitions and Improvements, in which said acquisitions and
improvements were referred to the Engineer of Work for the purpose of making
and filing a report in writing under and pursuant to the Municipal
Improvement Act of 1913; and
WHEREAS, said.report has been made and filed and duly considered by
this Council;
NOW, THEREFORE, IT IS ORDERED, as follows:

1. Said report as a whole and each part thereof, to wit:
(a) the plans and specifications for the proposed improvements;
(b) the maps and descriptions of the lands and easements to be
acquired, if any;
(c) the engineer's, estimate of the itemized and total costs and
expenses of said acquisitions and improvements, and of the incidental
expenses in connection therewith;

(d) the diagram showing the assessment district and the
boundaries and dimensions of the respective subdivisions of land
within said district; and
(e) the assessment of the total amount of the costs and expenses
of the proposed acquisitions and improvements upon the several
subdivisions of land in said district in proportion to the estimated
benefits to be received'by, said subdivisions, respectively, from said
acquisitions and improvements, and of the expenses incidental thereto;
are sufficient and are preliminarily approved.
2. Said report shall stand as the Engineer's Report for the purpose
of all subsequent proceedings herein.
3. Tuesday, July 1, 1986, at the hour of 7:00 o'clock p.m., in the
regular meeting place of this Council, Council Chambers, City Hall., brPalm
Street, San Luis Obispo, California, be, and the same are hereby appointed
and fixed as the time and place when and where this Council will consider
and finally determine whether the public interest, convenience and necessity
require said acquisitions and improvements, and when and where it will
consider and finally act upon said Engineer's Report.
4. The City Clerk shall cause notice of said hearing to be given by
publication once a week for two weeks in the Telegram -Tribune, a newspaper
published and circulated in the City of San Luis Obispo, and by conspicuous
posting along all the open streets within said assessment district at not
more than three hundred feet apart, and not less than three in all. The
first publication of said notice shall be made and said posting shall be
completed at least twenty days before the date herein set for said hearing.
Said notices shall be headed "Notice of Improvement" (in letters of not less
than one inch in height on the posted notice) and shall, in legible

characters, state and contain. the fact and date of the passage of said
Resolution of Preliminary Determination and of Intention, the filing of said
report, the date, hour and place set .for and the purpose of the hearing on
said resolution and report and of protests; the total estimated cost, and a
brief description of the proposed acquisitions and improvements; that any
person interested may file a ,protest in writing as provided in Division 12
of the Streets and Highways Code; and reference to said resolution and
report for further particulars.
5. Said Clerk shall also cause notice of said hearing to be mailed,
postage prepaid, at least twenty days before the date herein set for said
hearing, to all persons owning real property to be assessed whose names and
addresses appear on the last equalized assessment roll for general taxes or
are. known to said Clerk. Said notices, shall contain, in addition to the
matters provided above for the .notice to be published and posted, the
amount, as shown by said report, to be assessed against the particular
parcel covered by each such notice, respectively. Said notices shall be
mailed to such owners at their addresses as same appear on said assessment
roll, or as known to said Clerk, or to both if not the same.
6. The proposed boundaries of said assessment district are hereby
described as shown on a map thereof filed in the office of said Clerk, which
indicates by a boundary line the extent of the territory included in the
proposed assessment district and which shall govern for all details as to
the extent of such district, reference to such map being hereby made for
particulars. Said map contains the name of said City and a distinctive
designation in words or by number of the district shown thereon.
7. Said Clerk shall endorse certificates on the original and at least
one copy of said map evidencing the aforesaid filing and the date and

adoption of this resolution, and within 15 days after adoption of this
resolution, and in no event later than 15 days prior to said hearing, shall
file a copy thereof' with the County Recorder of the San Luis Obispo, in
which County all of such proposed assessment district is located. The
County Recorder shall endorse on said copy of said map the time and date of
filing and shall fasten the same securely in a book of maps of assessment
districts which he shall keep in his office, and index such map by the name
of said City and by the.distinctive designation of the district as shown on
such map.

WHEREAS, on May 20 , 19.86, the City Council of the City of San Luis
Obispo, California, - pursuant to the provisions of the Municipal Improvement
Act of 1913, adopted its Resolution of Preliminary Determination and Of
Intention No. 5965 for the acquisition and/or construction of the public
improvements more particularly therein described;
WHEREAS, said Resolution directed the undersigned to make and file a

And I do hereby assess and apportion said portion of said total amount
of the cost and expenses of said acquisitions, work and improvements upon
the several lots, pieces .or parcels or portions of lots or subdivisions of
land liable therefor and benefited thereby, and hereinafter numbered to
correspond with the numbers upon the attached diagram, upon each, severally
and respectively, in accordance with the benefits to be received by such.
subdivisions, respectively, from the acquisitions and improvements, and more
particularly set forth in the list hereto attached and by reference made a
part hereof.
As required by said Act, a diagram is hereto attached showing the
assessment district and also the boundaries and dimensions of the respective
subdivisions of land within said assessment district as the same existed at
the time of the passage of said Resolution, each of which subdivisions
having been given a separate number upon said diagram.
Said assessment is made upon the several subdivisions of land within
said assessment district in proportion to the estimated benefits to be
received by said subdivisions, respectively, from said improvement. The
diagram and assessment numbers appearing herein are the diagram numbers.
appearing on said diagram, to which reference is hereby made for a more
particular description of said property..
And because the names of the several owners are unknown to me, I hereby
place the word "Unknown" opposite the number of each subdivision of land
assessed, the amount assessed thereon and the number of the assessment.
Each subdivision of land assessed is described in the assessment list by
reference to its parcel number as shown on the Assessor's Maps of the County
of San Luis Obispo for the fiscal year 19_-19 and includes all of such
parcel excepting those portions thereof within- existing public roads or
right of way to be acquired in these proceedings for public road purposes.
For a more particular, description of said property, reference. i.s hereby made
to ,the deeds and maps on file and of- record in the office of the County
Recorder of said County.
