We urge you to uphold the determination of the Manning commission in the denial of this
project.
Had the Community Development Department adhered to their mission statement the project in
its present configuration would not have been allowed to go to the Planning Commission is it
fails to
...........ensure that San Luis Obispo continue to be a healthy, safe, attractive and enjoyable
place to live, work, or visit. ....support community values, persevere the environment, promote
the wise use of resources, and protect public health and safety.
There are multiple issue of failure to comply with development guidelines that were ignored by
the City planning staff. insufficient setback on Chorro and Foothill, excess height on the South
side of Foothill, multi -use where housing is to be above or behind commercial, token commercial
in proportion to project 6%, interference with view from Foothill and entry into the City from
Highway 1, safety of residents both in and near project due to dangerous intersection and
ingress/egress, disregard of noise impact and failure to fully evaluate. These issue are presented
in numerous correspondence to you, and included in the Planning Commission correspondence
as well as discussed at the hearing from which this appeal is taken.
The project proponent has attempted to create controversy and ambiguity that doesn't exist in the
various guidelines governing this project. It is well established in law that specific language
takes precedence over general i.e. The "North Side of Foothill" has clear meaning.
The Community Development Department, City Manager, and City Attorney are exercising a
political determination to support large development projects irrespective of our City guidelines
and residents' desire for smart growth. City staff is promoting any large development noting
potential of lawsuits, while continuing their dismissive and condescending response to residents
that "CHANGE IS HARD". The maintenance and preservation of a good City is hard; a lot
of hard work is required which is avoided by advocating for and accepting the position of
developers.
The project before you for 22 CHORRO is the wrong one for the location as was thoroughly,
reasonably, and thoughtfully evaluated by the Planning Commission in reaching their
determination to deny. No basis exists for reversal. The appeal is frivolous and the developer
clearly expressed at the prior hearing that he has no interest in working with the City as this is an
all or nothing project. There is undoubtedly a developer and architect able to design a project for
this special and prominent site to the benefit of the City and residents.
