I urge you to place your confidence in the Planning Commission and their decision to deny the project at 22
Chorro. During the PC meeting, the commissioners thoughtfully deliberated all aspects of the project. They had
an open dialog with the applicant in an attempt to strike a compromise, which included eliminating the upper
floor, requiring additional parking and adding retail space downstairs.
The Commissioners were also concerned that the project completely blocks solar access to the existing adjacent
restaurant, G Brothers. They also reviewed the General Plan and agreed that the higher density development
applies to the north side of Foothill while this project is on the south side.
The applicant was flatly unwilling to make any compromise and requested that the project be denied so that he
could appeal to the Council. This is disturbing on several levels.
Has the Council become the de facto Planning Commission? It seems to have become common practice for
developers to appeal denials to Council. Unfortunately, this tactic has paid off for some developers as Council
has upheld appeals.
Essentially, this sends a message to the Planning Commission that their decisions are incorrect. Why even have
a Planning Commission when developers are able to circumvent the system by appealing their decisions with a
favorable ruling from Council?
The Commissioners gave valid, legal reasoning for their denial. It was not illegal or discriminatory, as the
applicant contends. Please give the Planning Commission some credit for their expertise as planners. and
uphold their decision. The applicant can go back and follow the Commissioner's direction to come up with a
compromise that is consistent with the Community Design Guidelines and the LUCE.
As Council members, you represent the citizens of San Luis Obispo who elected you. You represent the
residents who live in the neighborhood that is directly adjacent to this project and owe a duty to maintain their
quality of life in terms of parking and other issues.
In addition to listening in the Planning Commission, I hope you will listen to the collective voices of your
constituents.
