Home My WebLink AboutR-10299 Results of 09-30-2011 electionRESOLUTION NO . 10299 (2011 Series ) A RESOLUTION OF THE CITY COUNCIL OF TH E CITY OF SAN LUIS OBISP O DECLARING THE RESULTS OF TH E SPECIAL ALL MAILED BALLOT MUNICIPAL ELECTIO N HELD TUESDAY, AUGUST 30, 201 1 WHEREAS,a Special All-Mailed Ballot Municipal Election was held in the City of Sa n Luis Obispo on Tuesday, August 30, 2011, as required by State Law and the Charter of the Cit y of San Luis Obispo ; and WHEREAS,two ballot measures, Measure A-11 and Measure B-11, were submitted t o the voters on Tuesday, August 30, 2011 ; an d WHEREAS,the County Clerk Recorder/Elections Official canvassed the returns of th e Special All-Mailed Ballot Municipal Election held on August 30, 2011, and has certified th e results to this City Council, the results are received, attached and made a part hereof as "Exhibi t A ." NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Lui s Obispo that : SECTION 1 .The whole number of votes cast in said election within the City of San Luis Obispo is reflected in the Canvass of All Votes Cast (Exhibit B). SECTION 2 .That ballot Measure A-11 submitted to the voters was as follows : Shall Section 1105 (Retirement) of the San Lui s Obispo Charter, which authorizes the Cit y Council to enter into a contract with the Board o f Administration of the Public Employees ' Retirement System (PERS), be amended t o provide that the City Council may terminate o r amend its contract or negotiate another contract to provide improved or reduced employe e benefits only in accordance with state law and a s permitted by the Board of Administration o f PERS? Ye s No Resolution No . 10299 (2011 Series ) Page 2 SECTION 3. That ballot Measure B-11 submitted to the voters was as follows : SECTION 4 . The City Council does declare and determine : That as a result of th e election, a majority of the voters voting on the measures relating to Resolution 10264 (201 1 Series), and Resolution 10265 (2011 Series) did vote in favor of them, and that the measure s were carried, and shall be deemed adopted and ratified . SECTION 5 . The City Clerk shall enter on the records of the City Council of the City,a statement of the result of the election, showing: (1) The whole number of ballots cast in the City; (2) The measures voted upon ; (3) The total number of votes for and against each measure . SECTION 6. That the City Clerk shall certify to the passage and adoption of thi s resolution and enter it into the book of original resolutions . Upon motion of Council Member Carter,seconded by Council Member Carpente r and on the following vote : AYES : Council Members Carpenter, Cater and Smith, Vice Mayor Ashbaugh an d Mayor Mar x NOES : None ABSENT : None The foregoing resolution was adopted this 6th day of September 2011 . Shall San Luis Obispo Charter Section 110 7 ("Impartial and Binding Arbitration for San Lui s Obispo Police Officers Association and San Lui s Obispo Firefighters Association, IAFF Loca l 3523, Employee Disputes") be repealed in it s entirety, leaving resolution of disputes ove r wages, hours, or working conditions, whic h remain unresolved after good faith negotiation s between the City and the two covere d organizations, subject to the same State la w procedures for impasse resolution that gover n other public employee organizations?
