CALL TO ORDER
A Regular Meeting of the Tree Committee was called to order on Monday, October 24, 2016 at 5:00 p.m.
in the Corporation Yard Conference Room, located at 25 Prado Road, San Luis Obispo, California, by
Chair Matt Ritter.
ROLL CALL

ACTION: MOTION BY COMMITTEE MEMBER SCOTT LOOSLEY, SECONDED BY

the meeting of Monday, September 26, 2016. Motion passed 4-0-1-2 on the following roll call

This item had been withdrawn from consideration.

113 DEL SUR (Canary Island Pine)
Dave Tarlton, applicant's representative, discussed the removal request and the remodeling
plans, stating that the Public Works Dept. is requiring a sidewalk be installed and the tree is in
the way. He reported that the owner would like to be in ADA compliance and was also going to
need to replace the sewer lateral.
Mr. Combs reported that the tree was healthy and he could not make his necessary findings to
approve the removal.
Public Comments:
Chair Ritter opened the public hearing.
There were no comments.
Chair Ritter closed the public hearing.
The Committee discussed the application and confirmed with staff that two other trees on the
site had been previously approved for removal and two required replacement plantings had not
yet occurred.
ACTION: MOTION BY COMMITTEE VICE CHAIR PARKER, SECONDED BY
COMMITTEE CHAIR RITTER, to approve the removal request based on undue hardship to
the property owner and required all three replacement plantings occur, with three 15 -gallons
tree to be chosen from the Master Street Tree list and planted within 45 days of tree removals.
Motion passed 5-0-2 on the following roll call vote:

Becky Foster, applicant, discussed the removal request and the desire to install solar panels; the
large tree was growing too close to the house and would block the panels. She noted the
property was heavily planted.
Mr. Combs reported that the tree was healthy and he could not make his necessary findings to
approve the removal.
Public Comments:
Chair Ritter opened the public hearing.
Steven Marx, 265 Albert, favored the removal and felt the surrounding trees would thrive is the
pine were removed. He felt it was the wrong tree in the wrong location and stated that he
supported solar efforts.

NEW BUSINESS
There was discussion on the Will Powers proposal regarding replacement planting actions, follow-ups,
and the required diameter of the replacement tree plantings.
The Committee agreed that City staff should have the right of follow-up review within the first three
years of replacement plantings to ensure that new trees are established and thriving and that any failing
trees will be subject to fines, as well as requiring a second replacement planting.
Doug Forrest agreed to draft language by December 1 and submit to Committee for review and
subsequent discussion at the December 12, 2016 regular meeting.
ARBORIST REPORT
Mr. Combs discussed the planned Arbor Day Celebration, scheduled for November 5, 2016 at Islay Hills
Park, from 10 a.m.to 12 p.m.
COMMITTEE COMMUNICATIONS

1. Large tree in parkway and in close proximity to structure.
2. City sidewalk is cracked significantly.
3. City sidewalk has heaved upward and is sloping.
4. Concrete entry stairs and landing slope towards the structure approximately
2.5 degrees.
5. Wooden half wall at stairs tilted inward towards structure approximately 2.2
degrees.
Notes
The above item(s) could be attributed to a heaving condition caused by the root
system of the adjacent tree.
Subfloor Area
Items Noted
1. Three cracks were noted in the concrete perimeter foundation at the front of
the structure.
Notes
While undeterminable it is possible the root system of the adjacent tree could be a
contributing factor to these cracks.

The existing concrete stairs, landing and wooden half wall are sloping and tilting
towards the structure. This is apparently being caused by a heaving condition
created by the root system of an adjacent tree. The rotation of the stairs and landing
could be putting undue stress on the foundation and framing of the structure. The
slope towards the structure could also introduce excess water to the foundation and
wood framing area. While beyond the scope of this inspection the 2.5 degree slope
may exceed allowed tolerances.
Recommendations
1. Consult with a structural engineer in regards to potential stress being created
on the structure by the rotation of the stairs and landing.
2. Consult with a structural engineer or architect in regards to maximum slope
allowed for stairs and landings.
3. Consult with an arborist about removal of the tree and root system.
4. Consult with a structural engineer about any necessary repairs.

Hello Steve,
It appears that the remaining eucalyptus are in a similar condition to the previously removed trees, in that, they
are exceedingly tall, growing very long and spindly at the tops, are beginning to seriously overhang the
pedestrian and parking areas, and are beginning to experience random failures resulting in very large, heavy
branches falling from a height of 50 -feet and more. Needless to say, should anybody be in the drop zone at the
time of one of these failures, the results could be disastrous.
To avoid a repeat of the recent past (a large eucalyptus branch falling and totaling a city vehicle) or any greater
incident of personal or property damage, it would be best to replace the existing trees with something less risky
and more manageable.
Additionally, our neighbor (AT&T) has offered to assist with funding of removal. I will attach to this email
contact information for the AT&T representative that I spoke with.

SUMMARY/BACKGROUND
A new 33 -unit multi -family residential project is being proposed on the site of the Historic Sandford
House located at 71 Palomar. As part of the review process an Initial Study of environmental impact
and Addendum were completed for the project in June 2016 and circulated for public review. This
document included an arborist report from A&T Arborists (Attachment 1). During the initial public
hearings of the project, staff received public testimony regarding environment impacts of the project,
including the removal of trees from the site. The Community Development Director determined more
information was needed and a third party consultant was brought in to provide additional analysis.
An independent, certified arborist reviewed the proposed project, visited the site and prepared another
arborist report (Attachment 2, Rincon Arborist Report). The additional information has been included
into the updated Mitigated Negative Declaration of Environmental Impact (IS/MND).
1.0 COMMITTEE'S PURVIEW
The Tree Committee is being asked to receive public comment and provide individual input to staff
and the ARC on the environmental document (IS/MND) and two arborist reports during the 30 -day
public review period for the proposed project located at 71 Palomar.

2.0 PROJECT INFORMATION
2.1 Site Information/Setting
The subject property is located at the corner of Palomar Avenue and Luneta Drive just south of
Foothill Boulevard and west of Broad Street within the R-4 (High Density Residential) zone. The
project site is 57,500 square feet (1.32 acres) and contains the Master List Historic Sandford
House as well as a secondary residential building, and a remodeled garage with adjacent carport.
The majority of the site is undeveloped and includes mature trees present throughout the site. The
site is accessed by two driveways along Luneta Drive and a pedestrian access from Palomar
Avenue. The proposed site is bounded to the north, east and west by R-4 residential developments
and single family, R-1 units to the south.
2.2 Project Description
The project proposes the rehabilitation, adaptive reuse, and repositioning of the Master List
Sandford house as part of a 33 -unit multi -family residential project (Attachment 3, Project Plans).
The project includes:
• Removal of the non -historic additions to the main structure;
• Removal of the non -historic garage, carport and the secondary residential building;
• Repositioning the house approximately 33 feet east and 16 feet south of its current
location;
• Rehabilitation of the historic structure and adaptive reuse for the proposed project's
leasing office and amenity space (study room, fitness room, etc.);
• Removal of 55 of the 59 existing trees on the site and replanting 34 trees;
• Construction of six apartment buildings (four, 2 -story structures; two 4 -story structures
built into the hill - all with a maximum height of 35 feet) with a total of 33 residential units
(five studios, sixteen two-bedroom apartments, and twelve three bedroom apartments);
• 63 parking spaces and 66 bicycle parking spaces within a two-level garage beneath the
two north apartment buildings, accessed from Palomar Avenue; and
• Road improvements to Luneta Drive including two-way traffic and raised medians.
3.0 DISCUSSION ITEMS
Staff is asking the Tree Committee to receive public comment and provide individual feedback on
the Mitigated Negative Declaration of Environmental Impact (IS/MND) and the supplemental
arborist reports (Attachment 4, Mitigated Negative Declaration of Environmental Impact).
4.0 NEXT STEPS
The project will continue through the Development Review process which includes the following
steps:
1. The Mitigated Negative Declaration of Environmental Impact will close for public review on
December 17, 2016.
2. Architectural Review Committee (ARC) Hearing (held after the 30 -day public review of the
initial study) on January 9, 2017.
