Hi,
I live near Sacramento and am the mother of a Cal Poly student living in San Luis Obispo. I unfortunately cannot attend
your upcoming council meeting. Is your 2/16 agenda an open public forum discussion on the housing inspection
program? If so, I wanted to provide some input as we are trying to gain some assistance and would love this to be part
of the discussion.
I wanted to say that the inspection program is a great program and we are very appreciative. However, we are now
experiencing severe retaliation from the landlord (Mike McNamara). While we understand the landlord's actions are
likely not legal and probably fall under retaliation, we don't have the funds (paying for her college is not cheap) to hire
legal assistance and are trying to navigate city and government resources on where to gain assistance. We are hoping
there is some way to enforce against landlord retaliation without causing tenants the time and financial resources to
fight such items!!
We would love to know if there are resources available to us and also to share this information during the forum.
Background:
My daughter is a Cal Poly student, living at This is managed by McNamara properties and
the landlord is Mike McNamara.
We had ongoing issues with the landlord in getting responses to ice cold showers for a long time. After numerous futile
attempts, we then contacted the city for the inspection program, they were extremely responsive and
helpful. Inspectors came out the same day and the landlord had to go thru many solutions before they arrived at a
solution that brings her hot water. She got hot water once she got back from holiday break in January. (Also, when she
moved in, the place was disgustingly filthy and it took 2 people night and day over a weekend to get it habitable). In all
cases, we have been told that if we were not happy, we could move and live elsewhere. Additionally, when I contacted
McNamara realty office to gain assistance on the shower, I was yelled at and hung up on twice. This is why we
contacted the city for their inspection program. For reference is the copy of Notice from the City Inspection program.
Last week, she received a notice of non- renewal (about 2 weeks after the shower repair and we understand it was an
extensive solution of some sort). When she called the realty company (McNamara realty), they said they will provide no
reason, it is their choice and it is final.
She is just a Jr and needs housing next year. They plan to rent this apartment after her lease is up in August and refuse
to rent to her. Her rent has been timely and aside from asking for repairs, she has presented absolutely no
issues. Additionally, McNamara owns many properties and it is highly unlikely they will rent to her anywhere. As you
know, affordable housing is extremely difficult and we are concerned for her Sr. year next year.

Dear Property Owner,
On December 8, 2016, City of San Luis Obispo Community Development Department staff noted the
following violations of the San Luis Obispo Municipal Code or other relevant codes at the above listed
address:
1. Permit Re wired SLOAIC 15.02.010 Cali brnia Plumbil!g Code 511.2.1
"It shall be unlawful for a person to install, remove, or replace or cause to be installed,
removed, or replaced a water heater without first obtaining a permit from the Authority
Having Jurisdiction to do so. "
The water heater was replaced without a permit.
Corrective Action: A water heater permit will need to be obtained and an inspection scheduled.
2. Water Temperature SLOMC 15.02.010, International Proper. , Maintenance Code 505.4
"Water heating facilities shall be properly installed, maintained and capable of providing an
adequate amount of water to be drawn at every sink, lavatory, bathtub, shower and laundry
facility at a minimum temperature of 110°F. "
The water heater does not provide an adequate amount of hot water for the residence.
Corrective Action: Repair or replace water heater in order to provide adequate amount of hot
water.
3. Insect &rgffilF 1SLOMC 15,02,010, tt ► ;atiunal E=em Maintenance Code 304.141
"Every door, window and other outside opening required for ventilation of habitable
rooms ... shall be supplied with tightly fitting screens of minimum 16 mesh per inch.
The window providing ventilation for the bathroom does not have an insect screen.
Corrective Action: An insect screen needs to be installed
4. Plumbin T Systems and Futures SLO.,YIC 15.02.010 IPAIC 12L 1
"All plumbing fixtures shall be properly installed and maintained in working order, and shall
be kept free from obstructions, leaks and defects and be capable ofperforming the function for
which such plumbing fixtures are designed. All plumbing fixtures shall be maintained in a
safe, sanitary and functional condition."
The plumbing in the bathroom is not draining/f inctioning properly and backs up.
Corrective Action: Make proper repairs to restore drainage functionality.
A COPY OF THIS NOTICE MUST BE ATTACHED TO ALL APPLICATIONS FOR A PERMIT.
We request that you voluntarily take action to correct the above noted violation(s) no later than January
12, 2017. These violations constitute a public nuisance and must be abated. Failure to correct the
violation(s) by the specified date will result in the issuance of an Administrative Citation requiring
payment of FINES in accordance with SLOMC Chapter 1.24. For Municipal Code violations that
remain uncorrected after issuance of an Administrative Citation, the City may seek enforcement by other
civil or criminal remedies.
Any person having a title interest in the property may request a Director's review of this Notice by
completing the enclosed Request for Director's Review Form and submitting it to the Community
Development Department, 919 Palm Street, San Luis Obispo, CA 93406, within five (5) days of the date
of this Notice. This Notice shall be deemed final unless you timely file a Request for Director's Review.
