Dear Mayor Harmon and City Council Members,
Re: 22 Chorro A
I wish to mention a few items relevant to the rnatt�r at hand (22 Chdrro)
which you may not have learned or considered.
■ When the City Council heard the developer's appeal, the City Attorney
told the Council members that a lawsuit was possible due to certain
protections of the State Density Bonus Law. Council members were
likely made uneasy by the implication that a lawsuit would be
problematic and very likely could not be won.
■ To my recollection it was not revealed if most unsuccessful lawsuits
alluded to were about density (as that element cannot be questioned).
• There was no mention of lawsuits that had been successful and what
the particulars were.
• Was the Council properly advised at that time that a legitimate
finding could be based on health, safety and welfare of residents?
• A number of residents emphasized the dangerous conditions of
congestion and safety at the corner of Foothill and Chorro.
• Government Code section 65915(e) states that nothing shall be construed to relieve
the local agency from complying with its congestion management program. And
compliance would involve denying an infill project when it is adversely impacted by
the surrounding environment or transportation patterns
THEN
When the project came before the ARC we diligently testified to the
Commissioners how the proposed project would very negatively impact an
entire section of town and that, in addition to various troubling aspects,
the intersection of Chorro and Foothill is extremely problematic and would
endanger bicyclist and pedestrian residents of 22 Chorro and others.
When public testimony was ended, Chair Wynn told us that he
had spent a good bit of time at City Hall that week and had been
told that ARC could not make any determination "...could do
nothing about it". He looked to Jon Ansolabehere to confirm that
was what he had been told and the Attorney agreed that was the
case.
You can imagine our dismay in going through all the motions to have it end like
that!
WHEN SOMETHING LIKE THIS COMES UP AGAIN, CAN WE GET A GONG
FOR CITY COUNCIL???
YOU HAVE TO PROMISE TO BANG THE GONG
WHEN A PROJECT LIKE THIS
The subject of `need for housing' in San Luis Obispo keeps being mentioned. That
`mantra' doesn't apply to projects this developer is proposing; housing for
students adds nothing to remedy the situation for housing workforce and families.
In fact, the over population of students in an area drives permanent residents out of the
area.
NO-- housing students in apartments does nothing for drawing students out of R-1
neighborhoods.

BEDS IN HOUSING SOUTH (newest dorms already full
Starts with 800 pulled out of triple rooms.
ENDS with students LIKE LIVING IN HOUSES!l
