Campbell and I am the owner of Lot #6 on Fixlini Street. My apologies for my absence at this ARC meeting. I am required to travel out of the area for my work. My husband, Bill Matthes, and our designer, Josh Blair will represent me. I purchased this lot in August of 2015. I am a graduate of Cal Poly SLO and have lived in this county for over 25 years. I raised my three children here, and been very involved in this community. For 11 years, I have been an Early Childhood Instructor at Cuesta College and have been a Hospice volunteer. My previous husband was a well -loved dentist in this community until he passed away at age 45. We had always dreamt of living in SLO one day. That dream was not realized until 10 years after his passing. My purchase of the property on Fixlini signified many things for me — including the chance to live in SLO and to work right around the corner. I share this with you so that you may understand that I care very much about this community and I am saddened by the difficulties I have encountered throughout this process. My current husband, Bill Matthes, and I fell in love with the Fixlini property because of the beautiful views, and the trails behind the neighborhood and up into the hills. It was exciting for me. to create these plans that are very similar to a home that I grew up in. The "U" shape allows for a back courtyard for a sort of "outside room". The views of the back and side easements give me peace and the feeling of being in the spacious outdoors. Josh Blair, our draftsman, listened to our ideas and looked at my very rough plan and was able to draw it up perfectly. His experience in designing and drawing the plans for the other home plans on this street contributed to many of the details, and he was aware of the building restrictions and restraints in regard to making this dream feasible. Unfortunately, due to unforeseeable financial circumstances, I will not be able to build the Fixlini house, but have found a buyer who loves the plans as much as I do. After discussions with City staff, to eliminate an "on-site" parking space, an exemption had been requested. To correct this issue, the new set of plans, which are the subject of this appeal, provided for a tandem 3 -car parking garage. As Mr. Blair will tell you, the tandem 3 -car parking garage was the only way to correct the "on -street" parking space issue, without drastically toarc February 28, 2017 Page 2 changing the look and feel of the Fixlini house, due to the unique constraints of Lot 6. This rewrite was extremely time-consuming and costly. The CC&Rs governing Lot 6 do not prohibit tandem parking garages. This is both an attractive, convenient, and practical solution, for everyone, to fulfilling the parking requirements. In fact, each adjacent property has driveways long enough to accommodate additional parking (essentially in tandem) including mine. Finally, on Thursday, March 2, 2017, I received the enclosed e-mail from Steve Miller, head of the Tract 2570 Architectural Rules Committee which governs the development of Lot 6. Mr. Miller's e-mail essentially states that if I paid him $20,000 and allowed him to perform grading work on Lot 6 to build a retaining wall, he would cause this current appeal to be taken off calendar, and would approve my plans on behalf of the Tract 2570 Architectural Rules Committee. The agreement he references in his e-mail, regarding the payment for the retaining wall and the grading work, is inaccurate. It appears that the motivation here is solely for financial gain, and has nothing to do with tandem parking or the sufficiency of my plans for the Fixlini house. I respectfully ask you to reject the appeal of the plans for the Fixlini house. At the time of the sale of the lot, we discussed with Bill Mathes, and he understood & agreed, the need to have access to Lot 6 to build the retainage wall between Lot 6 & Lot 7. He said it would not be a problem as it will benefit both lots. He also promised to pay $20,000 towards that cost. If the owner of Lot 6 will give us something in writing and record it with escrow agreeing to pay the $20,000 for the retainage wall and will sign and release the Okay To Grade Approval, we will agree to the design and sign the Architectural Committee Approval of Plans.
