Dear Council Members,
Please deny the appeal for this wilful violation of conditions of approval for the appellant's project.
If you uphold the appeal, you are signaling that everyone who serves on an advisory committee is wasting their time since
no matter how egregious an applicant's violation of legal conditions, the Council will back the law-breaking miscreant over
the advisory committee.
We hopefully live in a culture and society of laws, which are supposed to apply equally to all.
The appellant had a process to seek relief if he was unhappy with the ARC's approval of his project's color/configuration
requirements, and that was to immediately appeal the color/configuration decision to the Council. He chose not to do that,
but instead to wilfully defy the ARC. He alone is solely responsible for the costs he must now bear to do what he knew he
was supposed to do in the first place. So don't feel sorry for him.
Approving his appeal would send a clear message that anyone can escape from any city project approval conditions
simply by ignoring them. Approval would be pulling the rug from beneath not only your advisory committees, but also your
staff who are charged with enforcing duly adopted conditions.
This is not a complicated issue. Just stick up for law and order.
