The time to appeal building design, finish colors, and articulation features was after ARC conditions were issued over two years ago on July 6, 2015! These conditions of approval called for the inclusion of a cut-stone bulkhead and a contrasting paint scheme, clearly specifying the colors as oyster haze and city loft. The ARC's final approval stated, "Any change to the approved design, colors, materials, landscaping, or other conditions of approval must be approved by the Director of the ARC". Mr. Kulick failed to do so. It is now too late for an appeal. One can have different opinions of the aesthetics and appeal of a structure, but our City's Community Design Guidelines and lawful processes must be followed! Personally, before I was even aware of this building's violations, I found it to be dark, dreary, massive, and monolithic. I believe the ARC's choice of colors and building articulation at the pedestrian level will make this structure an appealing addition to our downtown. Mr. Kulick has clearly flaunted the authority of the ARC. He has flagrantly disregarded their conditions of approval and has done as he pleased. Your only logical decision on this matter is quite clear. Please don't be dissuaded by Mr. Kulick's apparent letter writing campaign. It is paramount you deny his appeal and uphold the ARC's decision of July 6, 2015. To do otherwise is to open the floodgates to every developer who follows to use this case as a precedent to do whatever it is they please. Thank you. John Grady San Luis Obispo 1
