SUBJECT: Agenda Correspondence October 3, 2017- Agenda Item #13 (1135 Santa Rosa)
Based on an inquiry from the applicant, staff is clarifying for the record that the developer of 1135
Santa Rosa did request and receive a Certificate of Occupancy (COO) for the project. In this case,
the project planner was inadvertently left off of the final inspection list and the COO for the project
was issued with the existing colors and exterior finish in place, even though those colors are not
consistent with the conditions of approval for the project.
Approval of the COO does not relieve the project from complying with the conditions of the ARC'S
approval. The granting of the COO does not override the ARC'S resolution approving the project,
including its building colors. In this case, the building color issue was specifically identified and
discussed with the appellant during the course of construction.
The property owner has not voluntarily complied with this requirement, and a code enforcement
case has been initiated. This process gives the appellant the right to correct the issues by receiving
subsequent approval of the building colors and materials as applied.
