Hans \[ ] Sent: Friday, December 15, 2017 2:39 PM To: Fowler, Xzandrea <XFowler@slocity.org> Subject: Planning Commission Meeting 12/20/17 - Case #: USE-1024-2017; Xzandrea: In regards to Item #3(583 Marsh Street)on the agenda for the upcoming meeting, I am the real estate broker representing the landlord and tenant in this matter. The use that the tenant is proposing is an Escape Room, which is a new entertainment concept that is opening in many locations throughout the country. This entertainment venue brings in all types of customers including families with children, adults of all ages as well as some college students. An example of what the escape room is all about can be found on their website: https://bakersfieldescaperoom.com/ The two issues that are preventing the tenant from being able to operate under the terms laid out by the hearing officer under the Administrative Use Permit are as follows: 1. The use permit restricted the hours to 8 pm on weekdays and 10 pm on Friday and Saturday. The recorded CC&R’s for this property allow commercial tenants to be open for business from 6 am to 11 pm, 7 days a week. The tenant and landlord ask that they be allowed to stay open until 11 pm since restricting the hours to 8 1 pm or 10 pm would drastically hinder the business similar to a movie theater that would be required to close at 8 pm. Many of the residents that objected at the original hearing do not even live within a block of this location. Those residents that do live in this building understood that there would be commercial business on the ground floor and they agreed to the CC&R’s referenced above when they took possession of their premises. The use contemplated herein does not serve alcoholic beverages and in no way is this an undesirable use. The only noise that will likely be heard is people talking, laughing and enjoying themselves. This building was also built with an extreme amount of noise insulation allowing little if any noise pollution. 2. The requirement that the hearing officer may impose other restrictions on the business after 6 months, is an impossible condition. The tenant plans to make an extremely large investment in the space with tenant improvements, setting up the games in each room and training and hiring employees. No business is willing to spend this kind of money with the possibility of being shut down or somehow forced to shut down due to reduction of allowable business hours or some other condition that may make it impossible to conduct their business here. We ask that this condition be removed. I would welcome you to walk through the space at 583 Marsh Street anytime during normal business hours(or other hours if needed) to see the space.
