HomeMy WebLinkAbout01-29-20188 Item 3 - Cooper To:SLO Planning Commission Re:1041 Mill Street: Architectural Review of a New Oce Building, Including Requested Exception To Allow Two Unenclosed Parking Spaces Within the Street Yard From:Allan Cooper, Secretary Save Our Downtown Date:January 28, 2018 Honorable Chair Wynn & Commissioners - Your sta report states: ÅTwo unenclosed spaces are proposed in the front (street) yard setback, which is an exception for the ARCÈs consideration¼Sta recommends approval of the proposed street yard exception to accommodate onsite parking for the proposed use.Æ We urge you to deny this street yard exception as this decision is not a discretionary one nor does this decision lie within your purview. Parking within the street yard located less than 20 feet from the street right-of-way is a clear violation of SLOÈs Zoning Regulations. According to B. Yards Section 17.16.010 ÅEnclosed and Unenclosed Parking Spaces in Street Yard Prohibited. In no case may an enclosed parking space or required parking space from which vehicles exit directly onto the street be located less than 20 feet from the street right-of-way or setback line except as provided in 17.16.020E.2 below, or as provided in 17.17.055.D.Æ This exception will constitute a grant of special privilege inconsistent with the driveway and parking limitations upon other properties in the vicinity. If you approve this street yard exception, you will be setting a dangerous precedent.
