Land is one of the most precious of manki.nd's worldly possessions and, too often, history is replete with individuals and nations wairing over the control of each other's properiy. Those who shvggle don't survive; laad does. Less global — but still pertinent — is the owaership of individual lots and acreage. In California and locally, the path to "clear tide" to property was and is an evolutionary process. Without regulations, "ownership rights" become a nightmaze of gigantic proportions. Today, extensive bureaucratic organizations exist to insure such rights do aot become ensnared in a quagmire of legal challenges. . Tracing its origins to September 1, 1772, San Luis Obispo is one of the oldest settlements in the State of California, The establishment of the Mission San Luis Obispo de Tolosa by the legendary Padre Junipero Serra was strictly a religious exercise; not an effort to found a political unit. However, even then the plans of the Spanish crown were to eventually turn any missionaty outpost into a pueblo...a secular governed community with the church and plaza as ths center of town with individuals owning homesteads. UIItil such time as designation as a pueblo,the padres were trustees—not vwners—of the mission lands for the natives. Any governance was by the frisrs(rarely more than two per mission)and the military leader...usually a sergeant...to address the most serious issues. Beginning with the separation of Mexico from Spain in 1820, the mission lands were divided into large ranchos. As a distant Depa.rtment, there was often only vague governance by the Mexican government of the Califomios. The core community around the Mission had few amenities. In 1834, Govemor Alvarado declared the settlement as now a pueblo under the authority of an Qlcalde. The cential authorities in Mexico City, however, never approved the declaration. Some 20 yeus later, ttris lack of oi�icial recognition proved a tuming point in the poGtical organization of San Luis Obispo. With the advent of American rule and that of Statehood, the small settlemen�t lrecame the county seat but still had no official recognition as to its municipal form.At the instigation of Charles H.Johnson,an application was made to the Federal Land Commission to ha.ve the former mission establishment recognized as a pueblo. If it were so designated, the community would then be determined to cover four square leagues. Land is one of the most precious of mankind's worldly possessions and, too often, history is replete with individuals and nations warring over the control of each other's properiy. Those who struggle don't survive; land does. Less global — but still pertinent — is the ownership of individual lots and acreage. In Califomia and locally, the path to "clear title" to property was and is an evolutionary process. Without regulations, "ownership rights" become a nightmare of gigantic proportions. Today, extensive bureaucratic organizations exist to insure such rights do not become ensnazed in a quagmire of legal c1�a11enges. . Tracing its origins to September 1, 1772, San Luis Obispo is one of the oldest settlements in the State of California The establishment of the 1VTission San Luis Obispo de Tolosa by the legendary Padre Junipero Serra was strictly a religious exercise; not an effort to found a political unit. However, even then the plans of the Spanish crown were to eventually turn any missionary outpost into a pueblo...a seculaz govemed community with the church and plaza, as the center of town with individuals owning homesteads. Until such time as designation as a pueblo,the padres were trustees—not owners—of the mission lands for the natives.Any govemance was by the friars(rarely more than two per mission)and the military leader...usually a sergeant...to address the most serious issues. _ Begi.nning with the separation of Mexico from Spain in 1820, the mission lands were divided into Iarge ranchos. As a distant Department, there was often only vague governance by the Mexican government of the Califomios. The core community around the Mission had few amenities. In 1834, Governor Alvaiado declared the settlement as now a pueblo under the authority of an alcalde. The central authorities in Mexico City, however, never approved the declazation. Same 20 yeazs later, this tack of official recognition proved a tuming point in the political organization of San Luis Obispo. With the advent of American rule and that of Statehood,the small settlement becazne the county seat but still had no official recognition as to its municipal form.At the instigation of Charles H. Johnson,an application was made te the Federal Land Commission to have the former mission establishment recognized as a pueblo. If it were so designated, the community would then be determined to cover four squaze leagues. Such aclrnowledgment was denied and in 1856, the settlement was legisiatively declared a town based upon its(the Town's)own local survey and map by William Rich Hutton. It maintained the appellation until 1876 when it was designated as a city. This followed the federal survey of �867 and the purchase of tlie municipal site (about 6Q0 acres) for $690.82 ($1.25 per acre) five years later. Approximately SO acres already had been designated as belonging to the Mission. 4ver many years previous, various smaller tracts of land around the mission were divided,bought and so1d,homes and businesses built but — unless deemed a federal grant (patent) - land underlying any claim of ownership belonged to the federal government and not to the State, the town or city and, most importantly, to any individual. Vast amounts of federal land are still included within the State's bordezs. An act "to settle the title to lands" ia the Town was passed by the Staxe � ,` `r � / � legislators on March 23, 1868 and provided for municipal procedures to obtain title to local property and confirm ownership to land if possession preceded the act. To remedy the legal issues of ownership, individuals were required to petition the local authorities and pay a fee in order to be granted a Certificate of Purchase—not a deed—to � the property. If there was no challenge to the Certificate holder within six morrths, a deed could be granted (upon payment of$2.50). Recording any ownership interest (if done at a11) was through the County Recorder. The attached represents the surviving petitions made to the town officials(a Common Council)and then in 1876,the City Council. Hutton provided the earliest survey of the community. DATE #2: This date is when the petition was "presented" to the local government for approval. A secondary inventory of Iot petitions is by the petitianer's last name. An additional benefit from.the petitions is a list of ineeting dates of the community's leaders as no oi�ciat Minutes have been found before May 4, 1870. Within the preserved Minutes, hundreds of references are made to petitions being received and the dispositivn of requests...not a11 represented in the surviving documents. PETITION/PETITIONER: Penmanslup occasionally obscures cornect spelling of surnames...let alone differing versions by the surveyor and clerk, Petitions note if a person signed with a mark. A few have signatures of the person completing the request if not completed by the petitioner(usually an attorney). There are a few women petitioners. Initially, petitions were handwritten but beginning in 1870, a preprinted form was available. Some indicate when t6e petitioner (or ancestors) first "settled upon" the requested property. DESGRIPTION: Many of the descriptions aze rudimentary metes and bounds namatives with some referencing a neighbar's property line, a tree, fence, the Arroyo (San Luis Creek) aad such. Blocks (about 3 acres) and lot numbers are provided in the listing as a reference help and are not meant to be the sum total of a petition's property request. Many requests have no block and/or lot designations. Another avenue needing exploration is the relationship of such designations to any used in the federal survey. They ma.y have differed from those used in the Hutton ma.p. FEE: The fee depended upon the size of the request with $5 for properties under %2 acre; $10 if more and up to two acres; from 2 to 5 acres were assessed $l 5.,qny pazcel beyand five acres was in the $2U+ category. Special assessments below $S are self-explanatory within the pe�ition.
