My name is David Lamb. I currently own a condo at 842 Tarragon Ln, directly across Orcutt Rd from this proposed
project site. I lived there until last month when I moved to Nipomo while I sell the condo and look for another home. I
currently remain the president of the Tumbling Waters Homeowner's Association. The info packet incorrectly states that
Avivo Townhomes are south‐adjacent to the project property. That is false. Tumbling Waters is immediately south‐
adjacent. Avivo Townhomes is a different project, surrounding us and is not adjacent to the project. They are "kitty‐
corner" to it, on the other side of Sacramento, with a couple units also at the far‐end of Tarragon Ln, by the railway.
I have a few comments regarding the project:
BACKGROUND
There is no street parking along Sacramento Rd anywhere near the town‐homes, but instead only insufficient on‐site
parking. The only street parking remotely near the homes is the on Duncan Ln, accommodating 15‐20(?) cars. And the
city recently made some of THOSE spots 2‐hour parking from 6AM to 10PM, reducing their utility to residents even
further.

Nonetheless, some residents (especially those having single‐car‐width tandem garages) find themselves needing to park
on Duncan Ln. This means that young children have to cross Orcutt Rd with their parents to get to‐and‐from their
vehicle.
There is enough traffic on Orcutt Rd, that it can take a long time to turn left from Sacramento onto Orcutt Rd.
Bang the Drum Brewery often (weekly or so) has so many visitors/customers, that their parking lot fills up and their
customers need to park on Duncan Ln.
Bang the Drum Brewery often has live (and percussive) music outdoors at such a volume that it can be easily and
distinctly heard INSIDE the living rooms and bedrooms of condominiums across the road, even when all the windows
and doors of the condo are closed. This is in violation of their original agreement and understanding that it would not be
heard across the road. Note that the lowest floors of the condos are not at street level, but are about a floor up, so it
may be easier to hear than would normally be the case. Multiple noise complaints have been made and Bang the Drum
has shown themselves unable or unwilling to actually rectify the problem.
THEREFORE I REQUEST
1. Approval of the requirement that the applicant install a traffic signal at Orcutt/Duncan/Sacramento.
2. Rejection of the shared parking reduction, and no tandem garages for any residences.
3. Prohibition on outdoor live performance or amplifiers/speakers. All sound must be kept inside the venue with
the windows closed.
