CONFERENCE WITH LEGAL COUNSEL – ANTICIPATED LITIGATION Significant exposure to litigation pursuant to paragraph (2) of subdivision (d) of Section 54956.9: No. of potential cases: One. A point has been reached where, in the opinion of the legislative body of the local agency on the advice of its legal counsel, based on existing facts and circumstances, there is a significant exposure to litigation against the local agency. The existing facts and circumstances exposing the City to litigation include the following: Save Open Space Wildlife, an unincorporated association, has threatened CEQA litigation against the City regarding the City’s environmental review for the City’s Pilot Program for After Hour use for the Cerro San Luis Natural Reserve. C. CONFERENCE WITH LEGAL COUNSEL – ANTICIPATED LITIGATION Significant exposure to litigation pursuant to paragraph (2) of subdivision (d) of Section 54956.9: No. of potential cases: One. A point has been reached where, in the opinion of the legislative body of the local agency on the advice of its legal counsel, based on existing facts and circumstances, there is a significant exposure to litigation against the local agency. The existing facts and circumstances exposing the City to litigation include the following: In a letter dated February 13, 2018, New Heritage Family Limited Partnership has threatened litigation against the City regarding the City’s imposition of a certain condition of approval related to the Twin Creeks development project located at 791 Orcutt property and the 3330 and 3360 Broad properties. Likewise, in a letter dated February 15, 2018, Orcutt Associates, LLC has threatened litigation against the City based on alleged breaches of a Reimbursement Agreement dated October 2, 2007 related to the City’s processing and approval of the Twin Creeks project. Copies of each letter are on file with the City Clerk’s office.
