CALL TO ORDER
An Adjourned Regular Meeting of the San Luis Obispo Planning Commission was called to
order on Wednesday, March 29, 2019 at 6:03 p.m. in the Council Chamber, located at 990 Palm
Street, San Luis Obispo, California, by Chair Stevenson.
ROLL CALL
Present: Commissioners Hemalata Dandekar, Ronald Malak, Nicholas Ostebur,
Mike Wulkan, Vice-Chair John Fowler, and Chair Charles Stevenson.
Absent:
Staff: Community Development Director Michael Codron, Community
Development Deputy Director Xzandrea Fowler, Assistant City Attorney Jon
Ansolabehere, Associate Planner Rachel Cohen, Recording Secretary Summer
Aburashed.
Pledge of Allegiance
Chair Stevenson led the Pledge of Allegiance.
PUBLIC COMMENTS ON ITEMS NOT ON THE AGENDA

PUBLIC HEARINGS
1. Continued review of proposed ordinance amendments to Title 17 (Zoning Regulations) of the
Municipal Code regarding the land use program for Cannabis Activities with a statutory
exemption from environmental review, in accordance with Business and Professions Code
section 26055 (h); Project Address: Citywide, Case # CODE-1058-2017, City of San Luis
Obispo, applicant. (Rachel Cohen)1

The Commission recessed at 7:31 p.m. and reconvened at 7:41 p.m. with all Commissioners
present.
ACTION: MOTION BY COMMISSIONER DANDEKAR SECOND BY COMMISSIONER
MALAK, to adopt a Resolution # PC-1004-2018 entitled:
“A RESOLUTION OF THE SAN LUIS OBISPO PLANNING COMMISSION
RECOMMENDING THE CITY COUNCIL INTRODUCE AND ADOPT AN
ORDINANCE AMENDING TITLE 17 (ZONING) OF THE MUNICIPAL CODE
TO ESTABLISH LAND USE REGULATIONS FOR COMMERCIAL
CANNABIS BUSINESSES AND PERSONAL CULTIVATION, AND
DETERMINING THAT THE ORDINANCE IS STATUTORILY EXEMPT
FROM ENVIRONMENTAL REVIEW PURSUANT TO BUSINESS AND
PROFESSIONS CODE SECTION 26055 (h) (CODE-1058-2017)”
Motion passed 4-2-0 on the following roll call vote:
AYES: COMMISSIONERS HEMALATA DANDEKAR, RONALD MALAK,
NICHOLAS OSTEBUR, MIKE WULKAN,
NOES: VICE-CHAIR JOHN FOWLER AND CHAIR CHARLES STEVENSON.
ABSENT:
With the following recommendations:
• Periodically reevaluate buffers as current uses may change.
• Delivery service, testing, manufacturing, and cultivation that are not open to the public do
not need a buffer.
• Commission agrees with staff’s recommendation regarding hours of operation.

• Revise Table 9 (Exhibit B) to not allow retail stores or microbusinesses in the
Community Commercial (C-C) or the Tourist Commercial (C-T) zones but allow them
with Planning Commission approval in Service Commercial (C-S) zone.
• Staff add language to the Purpose Statement regarding cannabis being a schedule one
drug.
• Eliminate outdoor personal cultivation completely, with the possibility for review at
another time (Section 17.99.040B).
• Consider the enforceability of provision of Section 17.99.040.A(10), especially the
language “unreasonable impacts to persons of normal sensitivity.”
• Make the minimum age limit 21 for access to medicinal and recreational retail
storefronts.
• In Section 17.99.050.J. Retail - Storefront add Service Commercial (C-S) zone and
remove Community Commercial (C-C) and Tourist Commercial (C-T) zones.
• Retail storefronts should be located along an arterial street.
• One of the retail storefronts should have a medicinal license and may also have an adult
use license.
• Indoor personal cultivation should require a registration process.
• Supports staff’s recommendation for overlay zones.
• Buffers from retail establishments should be as follows: 1000 feet from schools,
playgrounds and public parks, and 300 feet from residential zones.
The Planning Commission also recommended the City Council earmark percentage of revenue
from businesses to go to education
ADJOURNMENT
The meeting was adjourned at 9:04 p.m. The next Regular meeting of the Planning Commission
is scheduled for Wednesday, April 11, 2018 at 6:00 p.m., in the location, 990 Palm Street, San
Luis Obispo, California.
