Please deny the project changes and instruct the developer to color the building as per original approval.When the issue
of the dark grey(black) color was first brought up to the City Council during public comment for non agenda items by
Professor David Brodie, Mr. Codron who was present indicated that was not the final color but in the nature of color
coat. Apparently CDD had issued an occupancy permit despite the failure to conform the color to the approved plans.
The subsequent process ensued by the developer based upon arrogance, time, money, and influential friends is not the
precedent that the City/Advisory Bodies should promote.
The extremely dark color fails to conform with community design guidelines. The number of people who like the color is
not the issue. Insist that the developer comply with the original approved plans. It is additionally imperative that you
remove condition (a) which allows the Community Development Director to approve changes to color, design and
materials. This stands in direct contrast to the purpose of this hearing which is to provide final action on this issue.
Condition (b) indemnity, is beyond the knowledge base and purview of the ARC.
