Apparently CDD had issued an occupancy permit despite the failure to conform the color to the approved plans. The subsequent process ensued by the developer based upon arrogance, time, money, and influential friends is not the precedent that the City/Advisory Bodies should promote. The extremely dark color fails to conform with community design guidelines. The number of people who like the color is not the issue. Insist that the developer comply with the original approved plans. It is additionally imperative that you remove condition (a) which allows the Community Development Director to approve changes to color, design and materials. This stands in direct contrast to the purpose of this hearing which is to provide final action on this issue. Condition (b) indemnity, is beyond the knowledge base and purview of the ARC. Thank you for your thoughtful evaluation and consideration of this issue. Lydia Mourenza, Anholm 1
